Copy of the email I sent to CXOs of Flipkart –
Dear CXOs/ Heads,
I would like to bring to your notice the illegal use of T&Cs by Flipkart for marketing, increasing sales, and misleading consumers into buying your products. While your company boasts on social media about the trump over Amazon in the festive season sale, the means used to achieve this are mendacious and unscrupulous.
Although, my experience deals with just a mobile exchange offer which went terribly wrong (thanks to your deceitful marketing), the whole idea of writing this email is to highlight the dishonest tactics used to the CXO of flipkart and later on to the social media users.
I bought a mobile in your so claimed ‘Festive’ mobile exchange offer which warrants the old mobile to fit in the T&Cs highlighted on the exchange offer. The T&Cs on the mobile talk about a function device with intact screen and an IMEI verification. This does not mention anything about ‘dents’, ‘cracks’ or any other physical damage. Basis of this, I order my phone which reaches me after more than a week and to my surprise the exchange is denied sighting 2 scrathes on the side panel. Although my phone is fully functional with no scratches of dents anywhere on the phone, I am denied the exchange. In order to exchange my phone, I had deleted all data, apps and formatted the phone. I sit on my couch here writing this email on my laptop, with a non-functional phone laying besides me as I was denied the phone exchange due to Flipkart’s dishonest marketing. When I call customer service, they blatantly lie about the T&Cs and refuse to get any seniors on the call. Eventually after waiting a long time on the call I get a senior executive named Payal who reads the T&Cs on the website which are surprisingly worded differently than the T&Cs on the mobile app. The T&Cs on the website have an additional line ‘The Screen/Body should not have any cracks/dent and screen should not be coming out.’ which is missing on the mobile app.
As a consumer, how am I responsible in ordering an mobile phone using your mobile app without reading your T&Cs on the website. If I have to read the T&Cs on the website, why do you have a mobile app????
I have taken screesnhots of the entire T&Cs on the mobile and web and attaching the same for your reference. I shall wait for a day to get a justification on this before I post these on social media. Hoping there is some honesty left with you guys that seems to be lost in trying to be a bigger brand than Amazon that has excellent Customer service, crisp branding and integrity in its functions as compared to Flipkart.
