Ref: Order ID. 408-3070931-2876331 of Amazon.in  dated: 23 Mar 2021.

Respected Sir,
I have the honour to draw your kind attention that I Sri Joy Biswas resident at Indira Nagar, Near UBI ATM, North 24 parganas, Birati, Kolkata – 700081.
I have been placed a Order at www.amazon.in online shopping website, e.i. ASSP vide Order ID 408-3070931-287633, and product sold by Third-party seller e.i. PINKO.
Product description :
“Reciprocating Air Compressor 3HP, (“Product”) Amazon ASIN : B07QN6Q3YF
Item Weight : 175 Kilograms.
Order Date :  23 Mar 2021.
Third-party Seller: PINKO
Return Window  : 10 days ( similar as Amazon fulfillment return and refund policy )
Above mentioned order placed to Marketplace Third-party Seller e.i. Pinko. The only description is Displayed as information about Third-party seller that is seller Business Name e.i. Pinko. No other information available such seller email Id, Contact No. Geographical Business location, Customer service contact. Another information available that is 10 days Return Policy for the said product.
As per Amazon legal policy description on behalf of individual Third-party seller covered by Amazon A to Z guarantee.
The following description show in seller return & refund page…..
“We want you to buy with confidence any time you make a purchase on the Amazon.in website or use Amazon Payments; that’s why we guarantee purchases from third-party sellers when payment is made via
the Amazon.in website or when you use Amazon Payments for qualified purchases on third-party websites.”
 
As per buyer guarantee intervene or influence or informative confidence help me to motivate for purchase product from Third-party seller of ASSPL Marketplaces.
Next, I have placed order on 23 Mar, 2021 from online shopping website https://www.amazon.in e.i. ASSPL Marketplaces Third-seller ( Pinko).
As a consumer I know only www.amazon.in and my order item price Rs.44040 INR transactions paid by Rupay debit card *7050* to Amazon pay official account that show same on sender bank and receivers bank also. So no one consumer willing to paid any single rupees direct to Marketplace individual Third-party seller e.i. PINKO because the information about Third-party seller have less informative, they have no identically information.
It only show the marketplace Name for their amazon.in storefont. It may be example @ Ram @shyam @Rahim or X Y Z, that only know the Marketplace individual Third-party seller name.
So a Buyer have no prominent idea about third-party seller and their services. Buyer have only idea or Confidante about Marketplace mediator (amazon.in) ASSPL,  because A to Z guarantee covered the claim if third party seller order any dispute occurred.
However , I received a small size box on 25 Mar, 2021. Amazon last EOD was 30 Mar 2021.
The following information of the delivered product :-
Item Weight : 0.270 Kilograms
Tracking number : V61413346 of DTDC
Box Dimensions : 178mm x 105mm X                                       105mm
 
In the box contains a cell phone cover only. I am not get my original order but Amazon tracking information show order delivered successfully.
As per Amazon legal policy buyer have to wait till Last Estimated Delivery Date + 3 business Days for any unavoidable circumstances.
So last EOD 30 March 2021 + 3 business Days
= 3 April 2021 I file a complain about delivery item and waight, Meterialy different item delivered to there customer service as well as contact individual Third-party seller.
I have sent notice 4 times third party seller, ASSPL buyer support team also sent notice 2 time to seller e.i. Pinko.
On 3 April 2021, one of there representative guiding me for A to Z guarantee Claim.
Claim has been denied on same day. Further I appeal on denied claim by explaining all circumstances evidence photo proff , delivery parcel weight ( 0.270 grams )  printed by shipper (DTDC) and DTDC official tracking system show that parcel article contains only Manual ( documents ).
All information sent to all possible contact of Amazon marketplace and seller also. This process repeat 5 times. But reply is same. Customer service reply some time wait for 2 business days. Next reply wait for 3- 5 days, and than waiting 7 days because we. Are waiting for seller response.
Last 17 days waiting for resolutions and than I received a mail which subject is “without prejudice”

averments of your E-mail in seriatim and therefore, no part thereof, should be presumed to have been
admitted on account of express or implied non-denial or non-traversal.
In view of the above, the issue stands closed from our end.

I prayed to Ld / counsel that ASSPL and There Third party seller both denied the liability. Seller not responding at all and Amazon ASSPL impose all liability above Consumer. ASSPL aware about all dispute.
But that playing with consumer by the company incorporated under the provisions of the
Companies Act, 1956.
I am suffering for made transaction Rs. 44040 INR at ASSPL Marketplace and the same paid amount has been received acknowledge by amazonpay getway.
In early purchase stage A to Z guarantee advice to purchase with confidence. However, this transaction has become dispute. It is not resolve till now.
It is identically proff that seller broken  Marketplace fair business rules.
If a Third-party Seller not respond, than buyer can file a Claim. 
I have all documents regarding this order related issue, all communication documents, all customers service discussion, and delivery related documents,
Pre-order stage information, A to Z guarantee legal policy document recorded for further investigation.
Amazon misleading their customers and  I found negligence & deficiency of services in E-commerce marketplace Entity e.i. ASSPL.
 
The simple solution they not understand that I am not getting any service or product for the same amount I was paid for the same order. 
ASSPL www.amazon.in misrepresenting information about Third-party seller and A to Z guarantee assurance influence me to buy from the marketplace 3rd party seller. This information leading me to financial harm & mentally harassment
Since last 30 days.
 
Please help me out, I am seeking justice.
Amazon don’t care about customer thay denied all facilities for my order. They refused to refund.
I am not violated any condition of marketplace.
Ld / counsel i pray for your justification.
Please advise me.
