Refund of CHIS membership due to misrepresentation and hiding of facts before signing agreement, did not let us read agreement before signing it and non availability of its services

My complaint is against Country holidays inn and suites private limited. I have made the request for refund to them in march, 2021 also but again i was manipulated and promised that i will get all the bookings from future and so the refund could not be made. But since my first booking request till now i have really suffered a lot mentally. CHIS really harass people mentally deeply.

I paid Rs. 80, 000 on 12th September, 2020 in delhi on the basis of the oral agreement done between CHIS by its sale team (Mr. Ajay rohilla and Mrs. Poonam) and me and my husband.
CHIS Team asked me to tell the medium of payment and then they took my husband’s credit card to check whether it will work or not and offer it gives. Further they came with the machine and said please put your code to check the offer and whether it will work and then they said congratulations you are our member now.
I was shocked at that time and raised a question how ? then again they manipulated us by saying they thought that we are ready for the membership and it is the best company in india and stuff. after that they came with the contract paper and some other pamphlets, vouchers. And asked me to sign the paper. however, when i started reading out the contract paper, the sale person did not let me read it and made me sign it by saying that sign it fast, we have other customers also to attend, you can read it when you will get its hardcopy with welcome kit, trust us you will thank us a lot for giving you this membership, etc.

But till now i never received its any hardcopy with any kind of welcome kit.

I feel cheated and humiliated by CHIS. The persons who sold me this mebership of 5 year, 6 night/7 day per year, does not take calls from my number even after 20-30 calls a day. And also every number that i was given in starting does not pick up any of my calls.
Every time before any booking i have to go through all this harassment and humiliation.

Now comes the struggling and harassment part with CHIS that i faced from starting. They are as follows –

1. Hotstar premium membership of voucher – i called, messaged, mailed unlimited times to sale team, voucher team, toll free number to redeem it. And at last after struggling for 17 days i got Rs. 399 in my paytm wallet which was for hotstar VIP membership and not premium membership. However voucher says premium membership.

2. ITC FORTUNE – Sale team has committed that i can utilise one night with breakfast, dinner, room decor, cake at any of the branch of ITC FORTUNE.
But when i started looking for the booking it was not available for all branches but it was only available in Manesar branch. Further when i tried booking it in manesar it was never available and at last after 4-5 months i got the booking but not at ITC but at Radission blu without any room decor but i got the cake after calling and messaging several time to sale team.

3. Rs. 5000 shopping voucher of my offers – i never got it but after again mailing, calling, messaging unlimited times to everyone i got a mail after struggling for 5-6 months which says that CHIS will minus Rs. 5000 from my next ASF.

4. Breakfast – CHIS sale team committed that breakfast will be available with every booking but it was not available with any booking.

5. My 1st booking from my 6night – i raised a request for kerala before one month but did not got it due inactive reason then i asked for goa booking as the sale team was ready to send me goa on the very next week of taking the membership in September. But in November, 2020 when i tried booking goa nights, they said it is inactive. Then i asked for jaisalmer booking but it was also inactive. And then finally i asked them what can you book and then i booked 3 nights in jim corbett in CHIS recommendation because no other location was active.
This active and inactive reason has not stopped till now i have paid in advance for 5 years but CHIS is not able to give me the booking of my choice mentioned to me before membership even once. What is the use of paying in advance for several places if i can not get the booking. CHIS has always given this inactive reason and deny me for the booking then where is my surety of money with CHIS.

6. My 2nd booking in gangtok – This time also i got mentally harassed for around 20 days for gangtok booking. I paid in advance for my air tickets because booking team said that the booking will be done and they will share the hotel detail by 15th march, 2021. And then they stopped responding to my mail and calls on that day and on 16th march they said the booking is not available due to sold out reason and after that when i went to Mr. gurtej of CHIS Booking team he gave the reason of inactive location and then again i get another mail that gangtok is not active.

7. My next booking request for goa and jaisalmer in November was denied again due to inactive location reason.

8. My other booking request for chandigarh was also denied in march month due to inactive location reason.after which i was promised that they will have all the locations from next month and also i can ask for active locations before booking so that i can get 100% surity of booking.

9. Now comes the july, 2022 this time before booking i asked CHIS for their active locations. And from their given option of location i applied for booking. But very shamefully this time also CHIS said that due to high occupancy they can not give booking.

9. I had words few times for refund to customer service handled by KIRAN, head of customer service VINEETA and AGM RAHUL ARORA. They all promised to revert back in a day on different dates but they all failed to do so and now has stopped taking my calls since many days on each and every number including there toll free and landline numbers.

It clearly shows that CHIS is fooling people at their best, they dont even provide resolution. They dont even attend their customers and fool them by giving time again and again.
And for booking failures first they ask to choose any location and then they ask to choose the location from active location and when we choose one they deny the booking by making excuses..

how badly its booking team, customer care, sales team , managers and each one of them manipulate with their words is awful. At once they say they will give all bookings and then they say non active locations and then say other locations is active and then themselves ask to choose from particular locations given by them and then say that it is sold out and at then that it is not active.
And all this conversation happens over mails and phone calls for weeks and months and at last they give ZERO bookings.

All over the world is open now. But CHIS says they are still suffering from Covid time for active/inactive reasons and internal issues of CHIS.

However, when sale team was offering me this membership they never said that any locations can get active and inactive and also they never mentioned about 15 days prior notification. But then also i am informing before 15 days.
After that also CHIS Is not able to serve me and as per our Indian law and Indian contract act, 1872 the contract goes null, void, voidable, invalid at the very same time when any of the party is not able to act which was promised or if any party hide some material fact before agreement or at the time of the agreement, if any party signs it beacuse of misrepresentation, hidden facts, fraud it becomes invalid.

And here with CHIS my contract/ agreement is already invalid as the money which was deducted from my card was without my consent and the contract that i signed was not read and understood by me as the CHIS sale team did not allowed me to do so. And also they misrepresented everything about membership and CHIS company and they did fraud to us.

I can not continue this membership as CHIS has failed to serve/act what it has promised and because of hided facts, misrepresentation, continuous mental harassment and many more.
I request CHIS to return my money

Kindly add and deduct things which i have used from my gift vouchers, offers and membership after facing a lot of mental harassment and refund me the remaining amount by giving proper details.
