Received expired product from Swiggy Instamart Order.

Text of Complaint by Anshul Bhuwalka:

I had ordered “1x True Elements Crunchy Nuts & Berries Muesli” from Swiggy Instamart” on July 10, 2023 at 10:49 AM, bearing Order ID: 147935942245365. The product I received was completely dusty, and the plastic box of the product was crushed and damaged, without any air in the item. Because of this condition of the product, having holes in the plastic box, I checked the expiry date – which, to my shock, was June 26, 2023.

I approached Swiggy Instamart regarding the said issue, who replied stating they were only an intermediary and could not help with any resolution except for a refund. However, I have paid the partner fee, handling fee, delivery fee, and other charges along with the product charges. When I further tried to settle my claim, neither the resolution was provided, nor a customer care executive was answering to me, nor did my refund get processed. I was later asked to drop an email regarding my issue to Swiggy, and the chat was thereby closed without any resolution (attaching screenshot as evidence of the same).

It is to be duly noted that the product bearing Serial Number 8906112662155 has an original MRP of Rs. 595, which was offered on Swiggy Instamart for Rs. 488 only, upon a discount. The said discount is not provided on any other similar delivery platforms (like Zepto, BlinkIt, BigBasket, etc.) and is only available on Swiggy Instamart to be as discounted as for Rs. 107. The said high rate of discount associated with the delivery of expired product draws clear linkage with the ill intentions of Swiggy Instamart to dispose off the products to its customers without thorough check.

In the past, I have myself received expired items, but have simply claimed refund for the same. Upon Swiggy constantly repeating said grave offence, and after reading similar instances of many other customers (who have also raised consumer complaints), I am bound to put in this complaint against Swiggy Instamart.

Being a lawyer myself, I also foresee taking said complaint to the Court of law, unless my issue is duly resolved, and Swiggy has a strict policy in place regarding issues of this nature.

Please note that an error like this on Swiggy’s part is lethal for a consumer, considering consumption of said expired items could lead to losses which cannot simply be covered in monetary terms. Request to take up strictly with Swiggy Instamart.
