Ref.: Exchange of my Mobile isssue
For the past circa 8months I attempted to create a detail event history in layperson (non legal) of my exchange of old mobile that was done on July 17th, 2025, but that runs into 15pages. I realized only yesterday the date of expiry of my statute of limitations after purchase of my mobile from Amazon.in might have expired on 10th April, 2026, the date of my Amazon.in online order unless the court grants permission to use date of delivery to me, viz.: 18th April, 2024, as I will beg later.

I used this MOBol Y2 for circa 15months and did not detect any major defect. Also, as per amazon.in terms and conditions, I am supposed to report any defects within 3 days of delivery so, circa 21st April, 2024. Circa March/April 2025, I cotacted Amazon.in call back service about their listed item Motorola G45 (8/128GB) that was listed under ‘exchange old mobile’ but staff directed me to Motorola Lenovo India (hereafter referred to as MOLI) on Whatsapp where their AI assistant responded that there was no exchange offer for G45.

I located a local seller, viz. Captain Mobiles (hereafter referred to as SELLER.cmb) ~(contact person c/o Ashik, mob. xx-xxx-xxx92) Address, Ukkadam area,Coimbatore on July 17th, 2025 who had stock of an opened box (without bill of sale!) Motorola G45 details as below:

SELLER.cmb has ballpoint handwritten the marked sticker price =Rs.13,800/-. On july 17th, circa 1930 to 1955pm he was willing to exchange my MOBol Y2 (q.v.:jpg all accessories, in excellent condition, accessories were unused since I had my older charger and cables) for Rs.3,000/-
So I had to pay the difference Rs.10,800/-. I was short of Rs.800/-, so I told him I will pay him advace Rs.500/- perhaps non refundable, to prevent any other customer from buying this mobile (it could happen, in a few moments during my absence.) He then agreed that additional cash unecessary, but price Rs.1 0,000/-.

After viewing my ‘Amazon renewed’ box he declared my MOBol Y2 was ‘duplicate mobile’ wehen I explained other customer on Amazon.in had inside waranty/servce contract have accidentally damaged it, so Amazon.in have serviced this, so renewed.
I hope your honour understands the situation : I am about to purchase a product in an opened box from an unauthorized dealer, it appears new, but tests such as SMS to 1422 CEIR, IMEI test, Android 15 on G45 does not display type of processor, diagnotic,so additonal step of installing app such as CPU-Z is required. I had read customer complaints online of ‘newcomer processors’ (NOT genuine snap dragon OR Exynos, etc.) with complaints about 5G/4G connection, device charging issues, etc.

I then ran CEIR 14422, SMS test of G45 IMEI as recomended by a Youtube user to detect any flag ‘LOST/STOLEN’ warnings. The result did not display any discrepancy.
I then paid the amount Rs.10,000/-. He then proceeded to destroy the in box fold out userws manual, literature and removed the boxed 20W chafger (typical list price on Amazon.in Rs.360/-) but, provided a C type to USB-A 1m charging (white)cable (estimated vlaue Rs.100/-, note MOBol Y2 effective pric3e now 3000/- -360/- +100/- =Rs.2,740/-. I did not raise issue about the boxed charger, since perhaps his resale marging for MOBol Y2 might be less.

I then removed my screen tempered glass from my MOBol Y2 that was not part of the deal and stuck it on the slightly larger display of my new G45, that was an accepatable fit. I no longer had the rear sticker paper that comes with the tempered glass, since SELLER.cmb already providd a preinstalled tempered glass with G45. I offered them my clear silicone back cover, for free (est. value befoer depreciation Rs.150/-) since I no longer had use for that and would be safer for MOBol Y2, protection from scratches until next customer arrives, but they didn’t want it.

I then packed my G45 insid the provided manufacturer original box, then placed in my zipper bag,locked with pad lock. I had not yet logged into my Android acount or not yet instaqlled my SIM card (so no weaqr and tear) that I planned to do after reaching my residence. He then insisted I also have to pay additional Rs.800/-. Kindly note the SELLER.cmb (first) breach of contract. MOBold Y2 effective price now Rs.1940/-.

At around 2000pm he sent his assistant to walk with me for about 100ft north, toward ICICI group bank ATM, but, I explained my debit card works only for SBI group ATM, so we returned back south.

As we passed Captain mobile shopm, we stopped explained the situation to Mr.Ashik who then claimed that my MOBol Y2 rear (main) camera lens appears a few mm ‘away from centre’ (q.v.: my jpg) from the larger protective glass. I immediatly asked him to demonstarate any vignetting or cropping in the camera image, but he did not do so. Messrs SELLERcmb are at fault for not detecting this ‘defect of manufacture’ before committing to agreed exchange price, so this gain is their (second) breach of contract.

I am not a mobile service engineer nor Xiaomi Redmi products deler, so I never realized therer was a defect of manufacture so never reported thsi descrepancy issue to Amazon.in as my April 2024 telephone records to their ‘call back’ service will show.

It ws at this stage that he used the very strong terms I was attempting to commit fraud, when I then offered him return of G45 in my bag, my SIM not yet installed, then they retun mypatment + MOBol Y2 :no further issue, escalation, explaining I am not servic engineer, so I was not aware of thie defect of manufacture.

I also offered to come back after 2 days with a quality (non shredding) Premier tissue paper, necessary to clan the G45 screen with alcohol drops after removal of the MOBol Y2 ‘second tempered glass’ i.e.: clean the exposed display surfaces of G45 :no need to remove preinstalled G45 tempered glass. This was made in good nature since they have to resell the G45.

I even made an offer they retain Rs.200/- cancellation charge for the trouble : wasted circa 1 hour time of both parties, again they refused. I extended the offer again in good nature to Rs.500/- as cancellation deductionm, they refund Rs9,500/- but they again refused.

Ukkadam area Coimbatore is an unstable area, as law enforcement are aware. A few months ago, I once saw a man being beaten
up by another group of persons so to avoid further confrontation I politley walked away as soon as possible.

As I had stated earlier, I used bar code to message MOLI support on july 18th, 2025, circa 1218pm and was allotted automated response ref. incident 250719-001036. I received an email july 19th circa 1040am (sub.: my G45 product registration) Their reply by this email was that “…they could not understand my question…” I will forward this case number and URL to MOLI. I herewith beg the court to decree the warranty status of my G45, if any post service warranty contract I have to purchase from MOLI. I have had some days to think and also request MOLI to clarify any other status, such as unpaid bills by former customers for my G45. I herewith state that I am not complicit with SELLER.cmb in attempting to defraud these creditors (such as Non banking Finance companies, it could happen due to ansene of bill of sale) since I have to date no knowledge about the existence of these creditors claims on my G45. I beg the court to direct MOLI to enquire with their authorized de3aler from where SELLER.cmb purchased this G45, in order that these creditors should continue to take up their legal claims with SELLER.cmb I cannot express in strong enough terms, similar to leveling charge of fraud against me, the stress caused to me by suggestion of complicity with these parities attempting to defaud the creditors.

I had used my G45 on my Airtel SIM for about a month in August, 2025 (q.v.: *#06# screenshot, shows my outgoing call record to Zomato restaurant) I had removed my SIM and installed it in a mobile borrowed from my relative, as a precaution until I opened this case in consumer court.

I regret that circa December 2025 due to lack of use, and accidental deletion of file where I had saved my G45 login PIN, I have forgotten my login PIN. I now have to send my G45 TO MOLI service for factory reset. The photo/jpg (q.v. ; my mobile number xx xxx xxx36 on lock screen) that are referenced here will be uploaded in my next few case updates, since I am unfamiliar with this web site, how to upload multiple photos for the same case.

I also beg the court as I stated earlier to grant the calculation date of expiry of jurisdiction of this court (viz.: 2 years) from date of delivery of my MOBol Y2, viz.: April 18th, 2024. I also beg the court to decree all further claims by any future pruchases of my MOBol Y2 of defect of mnufacture with Amazon.in legal services who are the original seller, who is at fault. I also beg the court for their decree on any other legal issus that I may not have mentionmed here due to my being a non legal professional, such as frivolous claims by SELLER.cmb.
