Text of Complaint by Mohd hashim:

Below notice is made by a lawyer every detail approx is available

That this is to bring to your attention, the persisting issue regarding the malfunctioning Whirlpool washing machine, model BW pro INV 8.5 KG 12 YMW, that my client had purchased from your concern on February 16, 2023.
That the said product was purchased at a price of Rs.25,500/- (Rupees Twenty Five Thousand and Five Hundred only), as can be verified via Invoice Number: DSD-C-SIRF1412 dated 16-02-2023.
That the product had an initial problem, within a few weeks of purchase, which was diagnosed and rectified by your concern, but the product being a defective unit, still could not match up to its full potential with regard to the washing and clothes had to be manually washed with water after being cleaned.
That subsequently the malfunctioned again in the month of December 2023, and my client raised a complaint with regard to the same, and a technician from your concern inspected the unit, as can be verified via Job Sheet Number 4396.
That a replacement unit being ZIMC-ARA Replacement being a SW PRO PLUS H 8.5 KG MIDNIGHT GREY 10Y/M 31639 unit, was sanctioned but till date the unit has not been provided to my client.
That my client has raised several requests being Service Request Number DEL15122351980 dated December 15, 2023, and Service Request Number DEL28122309228 dated December 28, 2023, and Service Request Number DEL31122351427 dated December 31, 2023, and Service Request Number DEL07012402823 dated January 7, 2023, and Service Request Number DEL15012449838 dated January 15, 2023, and Service Request Number DELO2022429923 dated February 2, 2023, but to no avail.
That despite multiple attempts to address the problem, it remains unresolved, causing significant inconvenience, financial strain, and health risks to my client’s family, particularly his wife, who recently underwent surgery and requires utmost care and hygiene due to her compromised health condition after the birth of her new born baby.
That despite assurances and repair attempts, the washing machine continued to exhibit flaws, rendering it ineffective in performing its intended function, and none of the assurances of replacement have been fulfilled, despite repeated follow-ups and commitments made by the manufacturer’s representatives.
That this prolonged negligence and failure to provide a functional appliance not only breach the terms of the purchase agreement but also violate consumer protection laws.
That the situation is exacerbated by the health complications faced by my client’s wife, necessitating the urgent need for a reliable washing machine, as advised by medical professionals.
That it is pertinent to mention that several communications have been made by my said amiable client in other ways such as calls for resolving the problem but my amiable aforesaid client has not got any fruitful result and neither the problem has been resolved.
That no steps have been taken and no help has been provided by your concern to resolve my client’s issue.
That it is pertinent to mention that my client had been following up for so many days to which my client had to face harassment and mental agony due to the deficiency of service on the part of your concern which is a matter of great shame and regret.

That being deprived of the facilitated service my client intimated your concern on several occasions through calls, mails, and even personal meeting in respect of the service which has not been availed from your concern. However, you have acted like flogging of a dead horse in order to provide any resolution.

That due to your aforementioned malafide act and conduct my client got duped of the hard-earned money which is hindering my client in an erroneous way as my client has been facing tremendous noetic agony and due to the same my client has not been able to live the life in own accord.

That by your act and conduct my client has got agonized which is not at all tenable under the law and a proof of unfair trade practice.

Thus in order to resolve the difficulties of my client, I call upon you to duly look into this matter with foremost importance to provide a resolution by providing the replacement unit of refunding the amount of Rs.25,500/- (Rupees Twenty Five Thousand and Five Hundred only) along with Compensation of Rs.1,00,000/- (Rupees One Lac only) for service deficiency and harassment suffered by my client for an unreasonable delay from your side to refund back the hard earned money of my client, otherwise my client will have no other alternatives to file a case in appropriate forum for legal remedies. I would direct you to provide all the expenses in lieu of the possible recourse towards my client. I look forward to your reply and a resolution to my client’s problem and will wait until 7 (Seven) days of the receipt of this notice, failing which my client shall be constrained to initiate against you for redressal of the aforesaid grievances and recovery of the aforesaid amount such proceedings, both civil and criminal as are warranted by Law, the cost of which shall have to be borne by your concern.
