Text of Complaint by Miriam Mata:

I order a Valentino bag from Saks Off Fifth last September 30, but I received the wrong item, it was a snakeskin bag, and not only that, I have a phobia of snakes.
So I called customer service to let them know that I received the wrong item and I informed them that it was a snakeskin bag and that I have a phobia of that. They asked me if I can take a picture, and I told them that I cannot do that because I can not look at it even more than take a picture of it. I told them if they can just make a note of the description of the bag that I received. So they sent me a return label so I can return the incorrect item I received, and wait for the process.
After 2 weeks they return the item to me which is the snakeskin bag again, so I called customer service at Saks Off Fifth again asking why they return back the item to me, they said it was because I return the wrong item to them, so I told them the reason why I return the item it’s because I received the wrong item, why would I return the item if I received the correct item, again just by opening the box and seeing the bag snakeskin always makes me have panics that I almost throw the box. So they told me this time that they are going to send someone from FEDEX to pick up the returned item and that I have to wait for another 15 days again to process the refund. So I follow the process again and wait for them to process the refund. Just today November 19 they return the wrong item to me again and for the same reason that I did not return the correct Item.

I want to know if I can sue Saks Off Fifth for the stress and torture that they are giving me every time they send the snakeskin bag that I have a big phobia of and until now I am still waiting for my refund.
