- I am a former employee of Ecmas Construction Chemicals who has worked as Area Sales Manager (Kerala), Kochi from 2 Jan 2020 until 13 November 2020 when the company terminated me for not achieving my target in sales during the Co-vid time.
The reason why I am filing this complaint is because I have not received my salary for the entire period of September, Nov (13 days salary) plus 3 months basic pay settlement (which amounts to a total of Rs 1,92,994 )from Ecmas nor the Business Head/ CEO/ MD is paying any sort of attention to my communication in mails ,calls and WhatsApp when I ask them for the settlement/ benefits. My termination letter clearly states that I am entitled to 3 months basic salary plus my pending salaries.
I have been a faithful employee of Ecmas Construction Chemicals when I joined on Jan 2,2020 at Kochi. Prior to joining Ecmas, I had a good job with Asian Paints ( Calicut) and I managed to get a better opportunity with Ecmas (Kochi)and henceforth, I moved to Kochi based on the offer received from Ecmas Construction Chemicals Pvt Ltd. I even rented out an apartment in Koçhi based on the instructions from my immediate manager.
Everything was going well until Co-vid situation started .As you know the Co- vid situation has been hard in India ( especially Kerala ) for major business to happen and also the end users were not at all familiar with Ecmas brand in Kerala. Inspite of this, I managed to do my duty, struggling to get feasible sales. Management has already set a target prior to Covid scenario getting worse ( in january). Based on this target, they were still persuading me to achieve this target without changing any targets even in Co-vid time.Till August, company has been paying me timely salaries. For the month of September, company has not paid me my salary till date. October salary was paid to me after repeated follow ups with accounts team and after severe argument with my boss . I don’t know why company was showing soo much hesitation to pay me for the month of September. On November 13, company terminated me stating that my performance was not satisfactory. They also stated that
Pending Payment collection of Rs 1,92,096 under my account( Rs 36,588 from one company & Rs 1,55,508 from another company) has not been retrieved from my end. Ecmas HR also informed to return company assets which I did return to proceed with exit process.
I also managed to collect Rs 36,588 from the pending customer on November. Now only Rs 1,55,508 is pending from another company.
Because of me not settling this outstanding collection of Rs 1,55,508 from one of my customers, the company has kept my SEP entire month salary, 3 months notice period salary and 13 days of November month salary on hold. The company has not relieved me till date of my duties nor have they assigned any hand over person to take charge of the pending payment collection. The company just wants to put this pending payment collection amount of Rs 1.55 L in my name so that they will have a good justification to not pay my salary.
Without paying my September salary and other settlements, my house rent at Kochi and monthly EMI payments and other financial commitments have been on hold. I have been suffering immensely for the last few months because company has not settled me nor has given my relieve letter inspite of terminating me.
I came to Kochi to work with Ecmas. If Ecmas doesn’t pay my salaries,how can I pay my house rent and feed my family? I have also been eating food irregularly due to no money, sir.I need to find another job soon and progress in my career. Just because Ecmas terminated me and there is an outstanding collection from my end,does it mean that I will be deprived of my salary and deprived of finding a new job?
I have addressed these concerns to my immediate manager and the COO and MD of ECMAS. However, they have not taken any initiative nor show any sort of interest in my concerns. They just keep saying that I have brought loss to the company, they have paid everything and keep talking all management mighty statements which keeps pinpointing that all employees are at fault.
I must also say that many employees working in sales for Ecmas Construction Chemicals Private Ltd were deprived of their salaries. But unfortunately, most of these persons were hesitant to go and complain or fight for justice.
Inspite of signing the contract with Ecmas, the company has clearly cheated me by not paying my salary for Sep ( full month), Nov (13 days) plus 3 months basic pay ( notice period ) compensation. In addition, due to not paying my salary , it has also caused me emotional trauma, humiliation from my house owner in Kochi ( for not paying 2 month’s rent), not paying several dues on time as well as Ecmas management is frequently accusing me of wrongdoings just to cover up this non payment of salary.
Now, today ( 5 Jan 2021) when my father called the CEO of Ecmas on my behalf , he insulted my father saying that they will not pay any salary and was threatening my father to go court and fight for justice. This statement of the CEO has really infuriated me and now I am approaching legally to get the desired justice.
Trust I will get the justice that I deserve.
