Issue Regarding the Delivery of Wrong Product and Denial for Refund of Money after picking up the Return of Wrong Delivered Product

Text of Complaint by Priyank Chauhan:

On 10th December, 2023, I ordered a jacket of Amazon Brand – Symbols Women’s Regular Quilted Faux Down Jacket, XL, Olive for price of Rs. 1,529.00 bearing order ID- 403-5586486-7841117 from Amazon Application.
The product was delivered on 11th December, 2023 by the Amazon Delivery Agent. After receiving the product and on checking, it was found that the wrong product i.e Jacket of Fort Collins brand of blue colour has been delivered (Photos of wrong product which was received are annexed hereunder). Considering that the wrong product has been delivered, I placed the return request. Thereafter, duly verifying the same, the said wrong product which was delivered on 11th December, 2023 was picked up by your Pickup Agent on 12th December, 2023 bearing Pickup Tracking ID- 626506101890.
It’s been almost 2 weeks since the pickup of the wrong product was done at your end and the refund was not being credited in my account. Therefore, I tried to figure-out the same and was amazed to find that the status in the Amazon app showed “ Return not received: Your return is likely lost in-transit Do not worry! Our Customer Service can help you regarding the refund”. (Current Status Photo is annexed hereunder). Then I tried to connect with the Customer support. On contacting the customer support regarding the same, it was stated by the customer support that “Regarding this order a investigation was raised we’ve have received confirmation from our team that a incorrect item was returned to us. Hence we’re unable to issue a refund for the item(s) in this shipment.” Conversation made with the customer support is annexed hereunder.
I was shocked to note that wrong product was delivered by the Amazon, then the return package was lost in transit by you because of your negligence and now to cover up your mistake/error/default, you are blaming me for returning the incorrect item. This fishy act of Amazon give rise to certain questions which needs to be investigated and are still unanswered which are narrated hereunder:-
1. HOW CAN I RETURN THE RIGHT PRODUCT WHEN IT WAS NEVER EVER DELIVERD/RECIVED BY ME?
2. HOW CAN YOUR TEAM CONDUCT AN INVESTIGATION WHEN THE RETURN STATUS SHOWS RETURN LOST IN TRANSIT?
3. WITHOUT MAKING ANY COMMUNCATION WITH ME REGARDING THE SAME, HOW CAN YOUR INVESTIGATION TEAM DRAW THE AFORESAID CONCLUSUION?
4. THE PRICIPLE OF NATURAL JUSTICE WAS NOT FOLLOWED AND ABRUPTLY THE DECISON WAS MADE EX-PARTE.
The aforesaid act of Amazon shows the irresponsible and careless behaviour towards its customer i.e ME (AFTER HOLDING THE PRIME MEMEBERSHIP OF AMAZON) who is purchasing the goods/products from them with a belief and later on being felt cheated by them.
Thus, this act has shaken my belief towards the Amazon and due to that I very humbly request you to EITHER REFUND MY MONEY or DELIVER THE RIGHT PRODUCT WHICH I ORDERED OR RETURN THE WRONG PRODUCT WHICH WAS DELIVERED AND PICKED BY YOUR PICKUP AGENT?
Further to clarify, as on date product and money both are with you (AMAZON).
Therefore, Hoping to get a fruitful solution ASAP from your end regarding the same otherwise, I would have no other equally, efficacious remedy except to invoke the extra ordinary jurisdiction of the Hon’ble Court by initiating a legal action against your wrong doing. Then the consequences would be borne by you.
