Text of Complaint by Md Imran Ansari:

I, borrower of Bharat Loan , wish to file a formal complaint regarding illegal recovery practices, criminal intimidation, and unauthorized misuse of my personal data.

Loan Details:

Principal Disbursed: ₹65,000
Amount Paid: ₹40,000
Remaining Principal: ₹25,000

I am not a wilful defaulter and have repeatedly requested a fair settlement. However, instead of cooperating, the lender’s recovery agents are engaging in illegal and abusive practices as detailed below:

1. Harassment & Criminal Intimidation
Recovery agents are making repeated calls using abusive, threatening, and coercive language, causing severe mental stress.
This amounts to offences under:

IPC Section 503 & 506 – Criminal Intimidation
IPC Section 504 – Intentional insult to provoke breach of peace

2. Unauthorized Contact & Third-Party Harassment
Agents have contacted my father and other individuals, despite me never sharing their contact details. This is a direct violation of RBI recovery guidelines which prohibit contacting third parties.

3. Data Privacy Violation & Misuse of Financial Data
It appears that the recovery agents are extracting phone numbers from my bank/UPI transaction history and misusing that data to contact unrelated persons.
This is a serious breach of privacy and unauthorized use of personal data, punishable under:

Information Technology Act, Section 43A – Negligence in protecting sensitive data
Information Technology Act, Section 72A – Disclosure of personal information without consent

4. RBI Guideline Violations

Calling from hidden/private numbers without identification
Using abusive language
Harassing family members and third parties

These actions violate RBI Fair Practices Code and Recovery Agent Guidelines.

Due to this continuous harassment, I and my family are facing severe mental distress and fear.

Relief Sought:

Immediate action against Bharat Loan for illegal recovery practices
Immediate stop to all harassment calls and third-party contact
Investigation into misuse of my personal and financial data
Direction to lender to provide a fair settlement plan for ₹25,000 (remaining principal) via EMI
Restriction of all future communication to written/legal channels only
