Text of Complaint by sunil:

Respected Sir,
I, the undersigned is a law abiding citizen of India, want to draw the attention before your goodself that the undersigned is having the Credit Card of the RBL Bank 5236 5084 5312 3447 and I am using the same since 2017 years. I used the said credit card frequently and used to make payment to the bank timely without any default and the bank officials also appreciated my conduct.
In the month of Sep 2021, I used the said credit card and an amount of Rs. 139000.00 was due and payable by me. But due to Covid-19 outbreak, the peoples are facing financial crises world-wide. I could not make the payment of Rs. 139000/- + late fee and other charges to the Bank timely. I tried my level best to arrange the funds to make the payment to the Bank but my all efforts went in vain. Although, I met with the bank officials many times, on one occasions, I met with the bank officials and settled the dispute with them and according I have to make the payment of Rs. 105000/- (in three installments) as per settlement but with my best efforts, I could not make the payment to the bank. Resultantly, the bank transferred my case in the recovery.
Because of non-payment of the credit card payment, the aforesaid persons in order to harass me they are using filthy and parliamentary language with me and my relatives. It is relevant to mention here that the recovery agent has to talk to the customer in a decent manner but from last one week, the aforesaid persons are calling themselves as recovery agents of A.U. Small Finance, Recovery Branch, Noida and regularly making phone calls to me and my relative’s house (in-laws house of my daughter). The aforesaid persons made calls from Mobile No. 7678537130, 9711014365 and from others numbers to the house of in-laws of my daughter and also called my other relatives used filthy language with them, although, the aforesaid recovery agents have no right call at the mobile number of my relatives for the recovery of any payment, especially, when I am residing in Delhi and easily accessible to them, although the bank and its officials are free to take any legal action against me if there is any default from my side. By call my relatives and threatening or defaming them in the society, especially, when my relatives are neither guarantor of the payment or have any concerned with the transactions between me and the bank, such kind of offences are punishable under Indian Panel Code. The Hon’ble Court had pronounced many judgments and directed not to make call to the customers for recovery of the dues.
It is relevant to mention here that the Reserve bank of India various time has issued guidelines and expressed concern about the number of litigations filed against the banks in the recent past for engaging recovery agents who have purportedly violated the law. The banks were warned that if the RBI received complaints regarding violation of the guidelines provided in the circular and of adoption of abusive practices followed by the recovery agents of the banks, the same would be viewed seriously, including consideration of imposition of a ban on a bank from engaging recovery agents.
I, therefore, request your good-self kindly registered the FIR against the aforesaid persons for the criminal offences committed by them.
