Reference: BNPL/EMI Advance payment(Pay Later) from IDFC FIRST Bank Limited through the Flipkart Advanz Private Limited.
Dear Sir/Madam,
Under the instruction and authorisation from my client IDFC FIRST Bank Limited (“Lender”) having its office at “Naman Chembers, C-32, G-Block, Bandra-Kurla Complex, Bandra East, Mumbai – 400051, India”; I hereby serve upon you on this legal notice which may kindly be acknowledged:
That my client is a banking institution engaged in the commerce of lending credits/loans/facilities to its customers to cater their needs under the coded Terms and Conditions executed between my clients and its customers.
That you have approached my client to grant financial assistance for the orders placed by you from the partner merchants registered on the Flipkart Internet Private Limited (“Platform”) using the Flipkart Pay Later (“Payment Option”) extended by IDFC FIRST Bank Limited (“Lender”).
That you have jointly and severally availed a Flipkart Pay Later payment finance facility from IDFC FIRST Bank Limited; for a due amount of Rs. 5129.40 in June 2023.
That as per the terms of the Sanction Letter and Facility Agreement which you duly accepted and acknowledged, you agreed to repay the loan amount within the agreed tenure, time being the essence.
That despite having availed the financial assistance as above, you have committed various defaults in repayments of principal amount and interest. We wish to inform you that your loan account is in arrears of Rs. 5129.40 as on today, towards your monthly installment(s) or as per your repayment cycle.
As a result, your loan account with Flipkart Pay Later payment will be classified or has been classified as the Non-Performing Asset (NPA) after 90 days from your Due Date if remains outstanding as per the regulatory guidelines issued by Reserve Bank of India (RBI) from time to time.
Kindly take note that delay or default in payment of installment/interest will attract penal or delayed payment charges and may have an adverse effect on your credit ratings. We therefore request you to kindly make the repayment quickly.
That we therefore on behalf of my client require you by this legal notice to discharge/clear the liabilities by paying the outstanding amount within 7 days from the receipt of this notice, failing to which, we have the instructions from my client to initiate legal action against you before the appropriate authorities for the recovery of the due amount with interest and the entire cost of the legal proceedings(if any).
