Text of Complaint by KUMAR HARSH:

I, am lodging a formal complaint regarding a fraudulent loan entry and unauthorized contact information appearing in my credit record, constituting a serious breach of my rights under the RBI Fair Practices Code, the Credit Information Companies (Regulation) Act, 2005, and relevant provisions of the Information Technology Act, 2000.
1. Fraudulent Loan Entry
On Date : 12/08/2025, while reviewing my CIBIL report, I found the following entry:
• Loan Type: Two-Wheeler Loan
• Lender: TatLoan (as per CIBIL)
• Date Disbursed: 28/11/2017
• Sanctionrd Amount: ₹44,000
• Amount Overdue: ₹18,285
I have never applied for, signed for, or received any such loan. This entry was absent in all my previous credit reports, including in Aug 2023, when I successfully availed my housing loan.
2. Unauthorized Contact Number in My CIBIL Record
My CIBIL profile also shows a contact number, which does not belong to me, any of my family members, or anyone in my contact list.
The inclusion of this number without my consent indicates that an entity has direct access to alter my credit profile, which raises the risk of further fraudulent loan disbursals or misuse of my identity.
3. Legal Grounds for Action
This incident amounts to:
• Violation of RBI’s Fair Practices Code, which requires lenders to maintain accurate borrower records and ensure consent-based data reporting.
• Breach of the Credit Information Companies (Regulation) Act, 2005, Sections 17 & 20, which mandate accuracy and prohibit unauthorized furnishing of credit information.
• Offences under the Indian Penal Code – Sections 420 (Cheating), 468 (Forgery), 471 (Using forged document), and 120B (Criminal conspiracy).
• Offences under the Information Technology Act, 2000 – Section 43A & Section 66C, pertaining to misuse of personal data and identity theft.
4. My Requests
I hereby demand:
1. Immediate removal of the fraudulent loan entry and unauthorized contact number from all credit bureau records.
2. Full investigation into how my personal data was accessed and altered without consent.
3. Identification and penal action against the responsible persons or entities.
4. Written confirmation of corrective actions taken and a copy of the investigation report.
