I had ordered a Sleepx Mattress on Amazon on 29th April at 2pm. Order was supposed to be delivered on 30th April. At evening 7pm I receive a mail of cancellation due to pricing error.
On contacting, customer executive promised me of compensation of pricing diffrence if a fresh order Is filled but with a more price than price at which it was initially ordered.
However when I placed the fresh order of the same product the next day, Customer executive denied any compensation of pricing difference saying what was earlier said to me was a mistake from their end.
My point is this is a breach of Contract of Sale. The sale of Goods act, 1930 clearly says A Contract of Sale is:
an offer to buy for a price, or
An offer to sell good for a price, and
the acceptance of such offer.
The price quoted to me for a SleepX mattress was 840 (around)
I paid the amount & order was confirmed to me .
How can Amazon deny me the delivery claiming there’s any pricing error. If so, that’s not my fault. Amazon is contract bound to fulfill his commitment.
