Subject: Complaint against Vijay Sales – Defective Laptop Purchase

Dear Sir/Madam,

I, Smt. Kalpana Chawre, residing at Shree Sant Dyaneshwar Niwas, Bk-114, Ulhasnagar-421001, am writing to file a formal complaint against Vijay Sales, located at Gr& 1st Flr, Diamond Electric Industries, Red Cross Road, opposite Town Hall, Section 19, Ramayan Nagar, Ulhasnagar, Maharashtra 421003.

The details of the complaint are as follows:

Description of the Complaint:
On 4th September 2023, I visited Vijay Sales and purchased an Acer laptop, which was sealed in its original packaging. While at the store, I opened the sealed box, but I could not operate the laptop. After making the payment via NEFT to the respondent’s bank account, I took the product home and discovered that it was defective for reasons unknown to me. I immediately contacted Vijay Sales on 5th September 2023 to report the issue.

Initially, Vijay Sales requested me to bring the product to their Ulhasnagar address. They acknowledged the product’s defective condition but neither replaced the laptop nor provided a refund. Instead, I was directed to take the laptop to the service center at their Kalyan address.

Upon reaching the Kalyan address, I was not given proper assistance and was informed that I would need to leave the product with them for service, which could take 4-5 days. Finding this unreasonable, I returned to Vijay Sales’ Ulhasnagar address and demanded a refund.

From 5th September 2023 to 6th September 2023, I faced delays and was informed that Vijay Sales would adhere to their own timelines. However, after several discussions, Vijay Sales finally acknowledged the issue and agreed to provide a refund, via email on 6th September 2023 at 20:00 hours, without specifying a date and time for the refund.

Hence, I am filing this complaint as Vijay Sales failed to adhere to ‘General Practice and Terms of Business’ and instead engaged in ‘Unfair Trade Practices.’

My Claims:
I request the following actions to be taken:

a. An immediate refund of Rs.35,500.
b. A ‘Letter of Apology’ from Vijay Sales for the inconvenience and ordeal I have faced.
c. A ‘Letter of Assurance’ from Vijay Sales, guaranteeing that such ‘Deficiency in Service’ and ‘Unfair Trade Practices’ will not recur in the future.
d. Strict and necessary action against the staff and managers responsible at Vijay Sales.
d. Compensation of Rs. 2,000 per day since the date of the invoice until the refund is processed.

I have attached all relevant documents, including the invoice, for your reference.

I kindly request the Consumer Court to investigate this matter thoroughly and take appropriate action against Vijay Sales to ensure that consumers are protected from such unfair practices.
