received a message regarding data entry work. The lady named payal sharma (contact no +7069266757) share me work details also asked for the document and shared it then shared the agreement.
1 day after the work was completed, I got a call from their lawyer named Addv.yogesh jain (contact no. 9173163144) asking me to pay Rs 7200 as per agreement otherwise he would file a court complaint against me. I paid 7200 rupees to discontinue their agreement and then demanded 154000 with the threat that if I did not pay the payout then an FIR would be filed against me or I would have to go to the high court.
I received below message from their lawyer. .Dear Concern,
This Intimation Letter Inform you, That WOR KIFY NOW Company has filed a case under the SECTION of 73-74-75 of INDIAN CONTRACT ACT 1872 for contract breach against you as under law that mention on THE AGREEMENT that if you have not SUCCEEDED ON YOUR JOB THEN YOU HAVE TO PAY THE PENALTY AMOUNT.
Remedies for breach of contract.
Sec 73 – compensation for loss or damage caused by breach of contract proximate losses not remote/indirect losses.
Sec 74 – compensation for breach of contract Where penalty specified.Sec 75 – party who is rightfully rescinding is entitled for compensation.
IPC SECTION
SECTION-406 – Punishment for criminal breach of trust – Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
The above sections are implemented on you regarding you did not full-fill the terms and condition of your agreement..
If you want Avoid the Legal proceedings pay the company maintenance charges 7,200 within 30 minutes court server time.
Note :- If you are not closing this matter out of court settlement then after clearing this matter you have to attend in the court physically with your advocate.
