Text of Complaint by AMIT YADAV:

I got the call from the captcha filling and then they send me a link on whatsapp and asked me to join that. Where their camera was off and my camera was on . and they asked me my email id , whatsapp no and they said you have to do this work with 90% accuracy if you make any mistake your money will be deduct from your salary . They said that I don’t have to pay any registration fee, they said that it will be deducted from my first week salary. They send me a Stamp paper for my signature, I signed that but later I saw that date on stamp paper is JAN 8 2020. Then they send me an login id and password. I work for 8 days and completed their given work. But when I ask for salary on the 8th day. After 3-4 hours, I got a legal mail by Mr. Naveen Sharma ( Advocate at Vapi Gujrat) and when I asked him to send me the legal agreement he said that he won’t be able to send that because paper has legal stamp so they can’t share with us. And he was very rude just like a fake person trying and asking for penalty otherwise they will take this case to the court. He is making calls using tis no. 7284943151

I got this mail-

I’m a fresher, so I got afraid. I said him that I want to close this matter. First he said that pay 8650 Rs. To this account and your name will be cleared from this case . After he call and ask me that if you want to work with the company anymore or not? I said I don’t want to work with this company. Then he said you have to pay Rs. 17000 more to cancel the Agreement. I also paid the amount.

After that I got one more mail

Subject:- SECTION CLEARANCE

This Intimation letter informs you that MK PLACEMENT Company has filed a case under the SECTION of 73-74-75 of INDIAN contract ACT 1872 for contract breach against you as under law that mention on the AGREEMENT that if you have not SUCCEEDED on your job then you have to pay the penalty amount,

Remedies for breach of contract.

SECTION 73 – compensation for loss or damage caused by breach of contract proximate losses not remote/indirect losses.

SECTION 74 – compensation for breach of contract Where penalty specified.

SECTION 75 – party who is rightfully rescinding is entitled for compensation.

IPC SECTION

SECTION-406-Punishment for criminal breach of trust,Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.

The above sections are implemented on you regarding you did not full-fill the terms and condition of your agreement.

Kindly pay the fee Rs. 27800/- and clear your case after your file will be closed and you will get the clearance letter from the company side or we need to forward your file to send for the legal action in Delhi arbitrary court.

Note :- If you are not closing this matter out of court settlement then after clearing this matter you have to attend in the court physically with your advocate.

Today till 4:00 Pm you have time to clear your matter and you have to pay in the company’s account which is available in your registered mail account.
