I am submitting this complaint against Mahavira Finlease Limited, operating/providing lending services through Credit4Sure, regarding serious and unacceptable recovery practices involving repeated contact with persons from my saved contacts.
I am willing to address any genuine outstanding loan liability through lawful means. However, I strongly object to the manner in which recovery activity is being conducted.
The recovery personnel/agents associated with Credit4Sure/Mahavira Finlease have contacted persons from my saved contacts in connection with my loan/account. These third parties are not the borrower and should not be subjected to recovery-related calls, pressure, embarrassment or disclosure of my personal financial information.
This conduct has caused me considerable mental distress, embarrassment and reputational harm.
Specific grievances
My saved contacts have been contacted by persons claiming to be recovery agents/persons acting on behalf of Credit4Sure/Mahavira Finlease.
My personal information and/or information relating to my loan appears to have been used to contact third parties who are not parties to the loan agreement.
I have serious concerns regarding how my contact-list information was obtained, accessed, retained and disclosed/used for recovery purposes.
Such conduct has caused embarrassment and interference with my privacy and personal relationships.
If third-party recovery agencies/LSPs have been engaged, I request RBI to examine whether Mahavira Finlease exercised adequate oversight over their conduct.
I request RBI to examine whether the conduct is consistent with applicable RBI requirements concerning recovery agents, customer confidentiality, privacy and fair practices.
RBI’s customer-service guidance states that banks/NBFCs and their agents should maintain customer confidentiality and should not resort to intimidation or harassment, including conduct that intrudes upon the privacy of family members, referees and friends.
