Let’s try to understand the situation in order of events occurred:
1. HDFC Bank charged my joining fees on my credit card which actually waived by HDFC bank because bank representative made false promises to sale the card.
2. Now if I go as per regulations of GST, if value of service is zero or value of service reversed ( which normally known as sale return or revaluation of the amount of service) then GST can’t be charged as this is depend upon value of service but when value of service itself is zero then GST can’t be more than zero.
3. Now HDFC reverse the joining fees but did not reversed the GST amount which is totally against the law of GST act.
4. I was under impression that when fees is turned in to zero then i do not require to pay anything but in this month statement i got 2 charges, first is of GST on joining fees and second late fees because i didn’t clear my due last time.
5. Charges mentioned in point 4 are showing pending because of error from side of HDFC bank and they are not related to me at all. Reason of the same is as below:
a. I need to pay GST to government and government do not ask GST when value of service itself zero
b. Late fees: actually there is no question of late fees at all because there was no due from end last month.
