Complaint Against M.K.Placement, Rajkot, Gujrath about Fraud Captcha work.
My name is Ajit Prabhune, I registered on quicker.com for work from home job & upload my c.v.
I got a call from a girl , calling from MK Placement for a online captcha work. She told me our HR will take a video call interview for a selection, you just say “Yes” on every questions. Don’t say “No” otherwise you will not get the work. After video call interview , they send me the agreement copy for acceptance, but after reading the agreement, the terms & conditions which was mentioned was not acceptable to me. I didn’t signed & submit the agreement & send the mail reply for not accepting the terms & conditions for cancellation of agreement. Also phone to customer care & a girl about not interesting of work. I came to know that this company is fake. After 2 days they have send me user id & password for registration, but i immediately send the mail for cancellation of registration & user id ,password. They didn’t give any reply for cancellation of agreement & registration. On 11th June 2021, suddenly i received the legal notice from advocate Ajay Kulkarni, Rajkot, Gujrath about filled the case by MK Placement for under section 72,73,74 for breach of agreement & asked to pay penalty charges Rs.8950/- if you not paid, we will started legal procedure.

This Intimation Letter Informs you That MK PLACEMENT COMPANY has filed a case under the SECTION of 73-74-75 of INDIAN contract ACT 1872 for Contract Breach against you as under law that mention on THE AGREEMENT that if you have NOT COMPLETED (QC FAIL) on your job Then YOU HAVE TO PAY THE PENALTY AMOUNT.
Now as per The agreement which was done between you & MK PLACEMENT , We are hereby intimate you to pay the pending Due before 11 JUNE 2021.
Remedies for Breach of Contract.
Sec 73 – Compensation for loss or damage caused by breach of contract proximate losses not remote/indirect losses.
Sec 74 – Compensation for breach of contract Where penalty specified.
Sec 75 – Party who is rightfully rescinding is entitled for compensation.
IPC SECTION :
SECTION – 420- Cheating and dishonestly inducing delivery of property.—Whoever cheats and thereby dishonestly induces the person deceive to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
SECTION-406-Punishment for criminal breach of trust.—Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
