**Subject:** Complaint Against Incorrect Reporting in CIBIL Credit Report

**Complainant:**

**Opposite Party:**
Encore Asset Reconstruction Company (Encore ARC) – EARCPL / Concerned Credit Bureau (CIBIL/TransUnion)

**Respected Sir/Madam,**

I, Niranjan Nagaraja, hereby submit this complaint against the incorrect and misleading reporting of a credit account in my CIBIL report by EARCPL.

I have observed that the following credit card account is being reflected in my credit report:

* **Account Type:** Credit Card
* **Account Number:** XXXX-XXXX-XXXX-4868
* **Credit Limit:** ₹1,05,000
* **Current Balance:** ₹0
* **Amount Overdue:** ₹5,380
* **Date Opened:** 15/09/2014
* **Account Status:** Account Purchased

**Nature of Complaint:

1. The account shows a **current balance of ₹0, yet an **overdue amount of ₹5,380, which is contradictory and inaccurate.
2. I do not have any outstanding dues related to this account, and I strongly believe this entry is either:

* Incorrectly reported, or
* Not belonging to me, or
* Already settled/closed but not updated properly.
3. The account is marked as “Account Purchased”, which suggests transfer to an asset reconstruction company, but I have not been formally notified or provided supporting documentation for this.
4. This incorrect reporting has adversely impacted my creditworthiness and financial reputation.

Grounds for Complaint:

* Violation of my rights as a consumer due to inaccurate financial reporting.
* Deficiency in service by the reporting entity and credit bureau.
* Failure to ensure accurate and updated credit information as mandated under RBI and credit reporting guidelines.

Relief Sought:

I respectfully request the Honorable Commission to:

1. Direct the opposite parties to immediately investigate and correct/remove the incorrect entry** from my credit report.
2. Provide documentary proof of the alleged dues, if any.
3. Issue a No Due Certificate if no valid outstanding exists.
5. Ensure corrective measures are taken to prevent such issues in the future.

I request the Honorable Commission to take necessary action and provide justice at the earliest.
