COMPLAINT
Most Respectfully Showeth:
1. That the Complainant Velvetroots™ had placed a confirmed order with the Opposite Party on 06th January 2025, after evaluating samples provided by them, for the supply of various organic, chemical-free soap products (details listed in attached orders).
2. That pursuant to the order, the Complainant also issued an Acceptance of Prices and Order Confirmation on 09th January 2025, wherein a partial advance payment of ₹20,000 was made through UTR No. 413873075642 towards the order total of ₹37,140.
3. That despite repeated assurances and multiple promised dates from the Opposite Party, till date, no delivery of the ordered goods has been made. The Opposite Party failed to fulfill their contractual obligation even after the lapse of over three months from the advance payment date.
4. That the Complainant made several follow-ups and reminders requesting delivery or, alternatively, a refund of the advance paid. However, the Opposite Party has refused to refund the amount, causing financial loss, mental harassment, and disruption in business operations for the Complainant.
5. That the deliberate delay, non-delivery of goods, and refusal to refund amounts to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019.
6. That the Complainant has suffered financial loss and mental agony due to the Opposite Party’s negligence, for which the Complainant is entitled to compensation.

PRAYER:
In view of the above, it is most respectfully prayed that this Hon’ble Forum may kindly be pleased to:
a) Direct the Opposite Party to refund the advance amount of ₹20,000 along with 18% interest per annum from the date of payment till realization.
b) Direct the Opposite Party to pay compensation of ₹50,000 towards mental harassment, agony, and loss of business.
c) Direct the Opposite Party to pay the cost of litigation amounting to ₹10,000.
d) Pass such other order(s) as may be deemed fit and proper in the facts and circumstances of the case.
