Text of Complaint by Shashank Bagla:

Dear Sir/Madam,

I am writing to file an official complaint against OLA Electric, regarding delayed delivery of the electric vehicle I purchased from them. I have been subjected to unprofessional conduct and inconvenience, which I believe is a violation of my consumer rights.

I would like to present the following details regarding the matter:

Purchase Details:

Date of Purchase: 29th May, 2023
Total Amount Paid: Rs 1,40,945 (Full Payment) + additional amount of Rs 15,000 increased by them

Advertisement and Offer:

I received a call and advertisement from OLA Electric, stating that the price of the electric scooter was going to increase from 1st June, 2023, due to a decrease in the FAME 2 subsidy by the government.
The company offered customers the opportunity to purchase the scooter at the current price if booked before 31st May,2023.

Booking and Registration:

I booked the electric scooter on 29th May, 2023, in response to the aforementioned offer.
The waiting period for delivery was stated as 15 days, with an expected delivery date of 16th June, 2023.
However, OLA Electric intentionally delayed my registration process, which was not completed until 1st June, 2023.

Additional Payment Demand:

On 1st June, 2023, OLA Electric demanded an additional payment of Rs 15,000 in order to proceed with the delivery of the scooter.
The demand for additional payment was made abruptly and without any prior notice or valid explanation.
Faced with the prospect of cancellation and refund, I reluctantly made the extra payment on 6th June 2023.
Non-Delivery of the Electric Scooter:

Despite making the full payment and the additional payment as demanded by OLA Electric, the scooter has not been delivered to me by 16th June’2023. I have sent multiple emails to the Company and even reached out to the team on tweeter but received only one statement – “we are working on this and would reach out to you”.
The delay in delivery has caused significant inconvenience, frustration, and wasted my time.
Based on the aforementioned facts, I kindly request the following resolution:

Delivery of the Electric Scooter:

I request OLA Electric to prioritize the delivery of the electric scooter without any further delay.
Refund and Compensation:

1- I demand a refund of the additional payment of Rs 15,000 made under duress.
2- I also request compensation for the inconvenience caused, as well as the time wasted due to OLA Electric’s unprofessional conduct.
3- The compensation should be commensurate with the mental and emotional distress caused by this situation.
4- I have attached copies the order ID,as supporting evidence for my complaint.

I trust that the Consumer Court will take prompt action in addressing this matter and ensure that my consumer rights are upheld. I am confident in the court’s ability to provide a fair resolution.
