Text of Complaint by NISHAD.S.A ADVOCATE:

Under instructions of our Client, Mr. RAHAMATHULLA  KOTHWAL Office at. R. KOTWAL & Co, Advocates Solicitors & Legal Consultants High Court and Supreme Court and @ 04/1, 1st floor , A- Wing, HMS & HSS complex, Cubbonpet main road Bengaluru – 560 002, we cause this notice to you whereupon calling upon you from refraining from repeatedly harassing our client to make bill payments and refrain from disconnecting our client’s mobile connection, in continuation of such instances you shall be liable for the damages on breach of service conditions in not rendering obligatory service thereby losing faith and trust that the general people repose upon not only Bharti Airtel Private Limited but the entire service industry.

  1. Our client represents to us that, he is a very reliable customer of your services from past many years and it is very much evident from your customer records.
  2. Our client further represents to us that at the very outset while expressing his great applause about the services rendered by your Company to be one among the best in the world, regrets very much to tender his sincere grave concern that your Company would not be able to retain that what it earned previously in the global market.
  3. Our Client further represents to us that as per the statements made by your company executives, the company had assured our client about the willingness to provide him the best service available in the market on his telephonic number +919448312007 and +919591124275, under the international roaming benefits as he availed it with the intention of travelling abroad, which was subscribed by your customer care executive.
  4. Our client further represents to us that despite having invested copious amount on the monthly subscription, which only caused and highlighted the problem repeatedly while he was abroad, and later had to send a third person to Bangalore customer care center to resolve the issue and later problem was rectified after a week.
  5. Our client further represents to us that despite being very much active on the international roaming subscription plan and having been making payments on the subscription plan till date. Our client was shocked to see that copious amount charged on his billing amount. It is very much vital that the charges made are false and baseless with the only intention to loot our client.
  6. Our client further represents to us that despite availing the subscription plan and making payments regularly, your company has charged a fraudulent billing of Rs. 43,120/- (Forty three thousand one hundred and twenty only) for the period of 26-04-2019 to 26-05-2019 and 26-05-2019 to 26-06-2019, and further a new bill of Rs. 27,106/- (Twenty Seven thousand one hundred and six rupees)subsequently. These charges made by your company are very much exorbitant and monstrous and unacceptable for the alleged false service bill.
  7. Our client further represents to us that he is a practicing advocate in High Court of Karnataka and Supreme Court of India and has huge clients’ base and every day he is interacting with them. If the connection to his mobile number is disconnected, he will not be in a position to interact with them and advice them and will also cause huge financial loss to my client and also his professional reputation will also be at stake and your company will solely responsible for the damages occur.
  8. Our client further submits us that, your company representatives are regularly been making calls and sending the text messages and threatening our client regards to disconnection of his service on regular basis and is been causing him the mental agony, trauma, health hazard, for which the services he has not utilized and nor you have rendered, Further he states that he is been very much available in  the territory India, hence still the huge charges are being charged for the services not utilized from our client.
  9. Our client further submits us that, he has requested your company officials to look into the issue which is persistently charging the copious billing amount on his telephonic number’s due to your failure to rectify the issue for your personal benefits and negligent attitude of your representatives he is been suffering. Further our client looking forward to initiate the consumer legal proceedings against your company.
  10. Our client further represents to us that the inaction part of your company all along shows DEFICIENCY and NEGLIGENCE towards our client. It is the statutory obligation on the part of your company to supervise, control over the service onus obligation rendered to our client.
  11. Our client further has undergone a lot of mental harassment and agony amounting to torture by your company executives making threatening calls day in and day out. There cannot be any bigger mental harassment for false payment which is based on fraudulent service bill on which the services has been not utilized by our client nor been rendered by you.
  12. Our client further represents to us that you have cheated him with the false promise and low quality deficiency of service, carrying out to mental harassment to make payments on the untrue deceitful charges which is been falsely charged by your company, Our client is very much open towards the legal action against your company and its representatives.
  13. Our client further represents to us that he has lodged a formal complaint with the Ministry of Consumer affairs, Govt of India, https;//consumerhelpline.gov.in, at this juncture our client has spoken to various customer representatives with has failed to rectify the issue.

 

WHEREFORE, you are hereby cautioned that your repeated attempts to extract money stating illegal reasons and constant harassment by call is causing our client mental agony, trauma, health hazard, that our client is being made a victim by you for your unlawful gains, having made false representation shall no longer be tolerated as our client has paid the necessary dues that ought to have been paid. You are hereby further forewarned that our client being a legal stalwart having practice across the India including the Hon’ble Supreme Court Of India and in case of disconnection  of our client’s mobile connection would adversely result in tarnishing our client’s professional image which you would be solely responsible for due to your unprofessional, unethical and inefficient conduct making illegal gains and having twisted trade policies, where in necessary action for defamation and deficiency of service shall initiated and you shall be will be solely responsible for all the costs and consequences following thereon.

You are additionally liable to pay the sum of Rs. 10,000/- (Rupees Ten thousand only) towards charges of this notice.

You are further advised to retain this notice for future references and advised an amicable dispute resolution
