Amazon sold/send old phone telling it “New” on Amazon portal

Text of Complaint by Anil:

I bought a new Samsung phone (Model A7 SM-A720FZDDINS) from Amazon, the phone was listed in the “New” category and with a 1 year warranty period, in Amazon order details the phone was tagged as “New”. Phone was delivered on 22-Sep-2021.

Within 20 days we observed a phone battery runtime issue, it was switching off within 1-3 hours even with normal use. So, we visited the nearest Samsung Authorized Service Center in Deoband (Saharanpur UP). After checking Samsung Service Center found that the battery is swelling, during checks Samsung Service Center created a Job card for our reference & told us that the phone’s purchase date is 12-April-2021. We told Samsung that we bought this phone from Amazon and it was delivered on 22-Sep-21, we questioned them how it is possible, so on request they provided us the Job Card prepared for us which has purchase date 12-April-2021.

I bought this phone considering it “NEW” as Amazon or his seller has listed the phone in the New category, which is untrue and a fraud to customer.
Being the owner of this device, and to assure that I’m given the product for which I paid to Amazon/seller, and the phone not used by someone else illegally for criminal purposes before 22nd September; this is unacceptable to use such a phone which is not sold with the right information (I was interested only in new phone).

I contacted the Amazon seller and he is ready to return the phone (means he accepts his fault, you can check my chat with seller on portal), so he asked me to raise a return request with help from the Amazon seller department as it has been 20+ days since this phone was delivered to the time when the issue was found by Samsung Service Center.
I contacted Amazon service center, they told me that as the standard return policy period is over, they asked me to write to cs-reply@amazon.in and ofm@amazon.in with Samsung Service Center Job card clear scan copy to initiate return request. Note – This is not a standard case to consider under standard Amazon return policy as Amazon delivered something which was not listed on portal “Old purchase date device”, which was bought by customer & and which was written in amazon order details “a new device”).
Still I’m not seeing good support from Samsung.
