Text of Complaint by Sujit Mishra:

Lucrative free binge app for 7 days activated and on demand for recharge deactivated on 6th Jan 2022, but the unfair deduction was made from fresh Dth recharge on 28th Jan 2022 without any alert, intimation, demand, display (in Hidden illegal fraudulent form) in the Tatasky(play) app and not refunding despite repeated complaint at customer care. Sub: Complaint regarding unfair and unethical undisclosed deduction in the name of some “Binge” from the recharge value from the tatasky consumer number : 1312163213.
Sir,
With utmost concern and anguish I do hereby putting forth my grievance relating to the above cited subject for your kind appraisal and for resolution of the same as follows:
1. That, I’m a regular consumer of Tatasky DTH connection for my domestic use and paying the monthly accrued fair at actual till 28th of Jan 2022.
2. That, as usual on Dt: 28/01/2022, I received an intimation over Tv setup box as well as at my registered mobile no- 7978404718, that the monthly rental payment is due and unless I paid the same the view will be disrupted for non payment.
3. That, on receiving of the message I have opted to pay the rentals through the Tatasky app and got to know that it is changed to Tata Play. On inspection I have found that my actual network capacity fee along with paid channels would cost me an amount of Rs 212.00p per month or say for 30 days which was mentioned in clear, unambiguous view and without having any trace of hidden charges if any etc. and accordingly I have paid a sum of Rs 424.00 towards the fee for two successive future months, through Amazon UPI app, so as to continue my viewing uninterruptedly. But, to the utter surprise for me, when I came to know that your company has deducted an amount Rs 299.00p from my aforesaid recharged amount, which was quite shocking for me and also comes under unethical and unfair trade practice.
4. That, for your kind information the said binge app, which is a completely separated platform other than DTH, was downloaded on 7 days free trial offer and I have deactivated it on 06th Jan 2022, immediately when received an intimation of probable charges for the same, the deactivation was carried out by calling to your helpline number and got the same deactivated with assurance from your customer care representative of permanent deactivation.
5. That, on such appraisal, I have immediately communicated to the tatasky helpline and lodged my complaint citing the unfair deduction but all my efforts are gone in vein as your trained sweet talking representatives were just only keeps me under false assurance to resolve the issue. But, all my efforts were gone in vein.
6. That, despite my repeated communication your company officials and upon their false assurance, some lady from binge department keeps on calling me and trying to convince me that the fraudulent deduction if fair and it cann’t be refundable. As it is usual in trade practice that you cannot charge service fee for the service for what you have not apprised or informed the customer earlier at the time of paying of network charges with all terms and conditions in details, at least what your will get or what are you paying for?
7. That, After a long conversation over phone with your service providers, I have just feeling that your company is involved in illegal trade practice and keeps on looting innocent consumers without having any knowledge of them.
8. That, due to your illegal and unethical trade practice, in the form of illegal deduction in the name of some “Binge”, which is fraudulent also, your company has putted me with a irreparable financial loss along with serious mental agony, breach of peace in mind, which can’t be compensated in terms of any materialistic form.

It is therefore with good faith upon your company, I call upon you to resolve my complaint with a humanitarian gesture and refund the unfair deducted amount in the name of binge to my consumer account within 7 days on receipt of this mail otherwise treat this complaint/ intimation as legal notice and for which I would prefer to proceed into the proper forum to redress this issue in a lawful manner and in that case only your company will be solely responsible for all the cost and consequences arisen thereof.
