Text of Complaint by Mohd jia ul haq:

I am writing to file a formal complaint against Cosbike pvt limited and dealer Shri balaji electric world, the manufacturer of (V Fusion) F Prime Scooty, for a warranty-related issue that I have been experiencing with my vehicle. The matter pertains to a malfunctioning motor in my F Prime Scooty, which is still under warranty. However, the authorized dealer has refused to repair it under warranty and has demanded an exorbitant amount of INR 13,000 for the repair. I purchased my F Prime Scooty on a 23 dec, 2022 and have diligently maintained it according to the manufacturer’s recommendations. I have done 2 service, one left as I have time issue. I am student, have to attend collage then goes to hospital for internship and finally have to go for my job (delivery boy) at night. Among all these thing I forget 1 service.

I wish to provide the following details for your consideration:

Warranty Period: 3 YEAR OR 20,000 Km
Current Date: 10 sep,2023

(2) TRANSACTION
I paid a down payment of Rs39,400, and the remaining amount on the loan, which is being paid through monthly EMIs, total amount goes to totals Rs1,22,224. The loan is associated with the loan number CFB21413223, and the invoice number is SB/22-23/0121, with a total principal amount of Rs98,000.

(3) DEFECT/DEFICIENCY :
I encountered a significant issue with the motor of the scooty. The vehicle’s performance deteriorated, and it became evident that the motor was malfunctioning. It choked while driving. When I tried to start the vehicle motor didn’t work. M sign was shown in display, which indicate malfunctioning of motor. After 3 and 4 days after giving scooty for service, they show me 3 crack in plate of the motor, which is random crack, someone intentionally hammered on it. If there is natural crack its should be inter connected. But there was random crack. If it is a crack then how it can be possible, because dealer give me information that it can easily take load of 150-180kg. I was single person at that time.
Dealer have 2 excused at different time
1. Manager of balaji electronic world said we didn’t provide any warranty of broken part. According to me that part was not broken at that time when I left my scooty at service center.
2. The owner of balaji electronic world said you didn’t do your last service so we can’t ask any thing to company about warranty claim.

I promptly contacted the authorized dealer, [Shri Balaji electronic world], and informed them about the issue, hoping that it would be covered under the warranty.
However, to my shock and dismay, the dealer informed me that the motor issue would not be covered under warranty and demanded INR 13,000 for the repair. I am a student, I can’t afford a huge amount of 13,000.
In addition of it I would like to draw your attention on more things, dealer promised me to provide addition accessories, which is not provided till the date, so I denied to pay my last EMI, amount of Rs 5880. I have asked dealer to provide my that accessories a lot of time , I was ready to pay that amount but they did not give any Accessories till the date, you are requested to take action on it, I am still ready to pay that amount.
Overall, I think its dealer’s intension to make money. That is unfair.

(4) RECTIFICATION
Feeling that this was unfair and against the warranty terms, I requested the dealer to provide a written explanation for their refusal to honor the warranty. They failed to provide any such documentation.
I have also tried to communicate with Cosbike’s customer service department through emails and phone calls, but I have not received any satisfactory response. Even they didn’t answer my mail and didn’t receive my call too. Cosbike Company didn’t answer my call till the date. Company does not provide total service for which I have paid Rs1.20 lakh. It does under Deficiency of Service.
According to the definition under Section. 2(11) of Consumer Protection Act 2019.

(5) EEVIDENCE
I possess several pieces of evidence related to my interactions with Cosbike, including the invoice, email correspondences that I sent to Cosbike, and call details. Additionally, I have a cracked sample of my vehicle as further documentation.
In addition to these materials, I respectfully request the service provider to provide CCTV footage during the servicing of my vehicle. This footage is essential to verify the quality and integrity of the service performed. Specifically, I am interested in obtaining footage that shows the moment the motor of my vehicle was opened to ensure that no harm or damage was done.
Furthermore, I kindly ask that you inquire with the service provider whether they have ever serviced the motor of my vehicle and, if so, request any records or documentation related to such servicing.
I believe that these pieces of evidence and the requested CCTV footage will help in clarifying any concerns and ensuring the transparency of the service provided to my vehicle. If there is any Deficiency of Service, I request court to take action against it.
(6) SUPPORTING DOCUMENTS
I have enclosed copies of all relevant documents, including the vehicle purchase invoice, warranty terms, communication with the dealer, and my attempts to contact Cosbike’s customer service.
I believe that the refusal to honor the warranty and the unreasonable demand for repair costs are a clear violation of my consumer rights. I hope that the Consumer Court will look into this matter and provide a fair resolution.
I am ready and willing to cooperate fully with the Consumer Court throughout the proceedings and provide any additional information as required. I kindly request you to schedule a hearing at your earliest convenience to address this issue promptly.

(7) JURISDICTION
Due to the unavailability of my vehicle, I have encountered numerous complications, which have had a significant impact on my life. I was unable to attend my college due to a lack of funds for metro travel, resulting in missed classes and academic setbacks. Moreover, I found myself unable to meet the EMIs on my credit card, leading to penalties and financial stress. To make ends meet and cover my college fees, I took on a job with Zomato. However, even with this additional income, I am struggling to manage my financial responsibilities, and the accumulating pressures are taking a toll on my mental well-being.
Requesting you to make your decision as soon as possible.
(8) LIMTATION
That the present complaint is being filed within the period prescribed under section 24A of the Act.
