Please refer to complaint request no.SR0804192264007 dated 08.04.2019 lodged with Tata sky DTH provider related to my DTH connection registered mobile no.8124933056.

I had subscribed annual pack as per term and conditions in November 2018 and the same will expires in coming November 2019. After the latest regulation of the TRAI, the said DTH provider had suo-moto converted the annual subscription into monthly subscription and also withdrawn several channels as originally provided.

In this regard a request complaint as stated above was lodged but the same is resolved without any response. Prima facie it seems no action has been taken to redressed the issue, which indicates the lethargic attitude of the service provider.

Hence, it is requested that the plan originally chosen by me as per term and conditions for one year may please be restored with a request to compensate the period for which it is converted into monthly plan till conversion to original one. Yours sincerely. Om prakash patel.

  1. As per TRAI direction, following the new Tariff order, service providers will migrate their customers to the best fit plan carrying their key current channels. This process is being done in a phased manner every day to migrate the millions of customers by the 31st March. Each customer has the option of changing their channels and packs at any point in time, before or after the migration. For this, please download the Tata Sky App or visit http://www.mytatasky.com and go to Manage Pack, or visit your nearest dealer.

  2. Prima facie, the service provider has not provided the guidelines of TRAI relied upon to change the annual pack suo moto by them.
    As per clause 17 of the Telecommunication (Broadcasting and cable) Services Standards of Quality of Service and Consumer Protection (Addressable Systems) Regulations, 2017, “In case, the broadcasting services related to television have been availed by a subscriber with a lock-in period or the charges for subscription of broadcasting services related to television are paid in advance for a specific period by a subscriber in pursuance of any scheme offered by the distributor of television channels, the distributor shall continue to provide such services for such period to the subscriber without any increase in the price of subscription and without altering the other terms of subscription to the disadvantage of the subscriber.”
    DTH service providers feigned ignorance of the TRAI mandate.
    No customer can be disadvantaged by the new regime. If they want to continue with a long-duration pack, they can do so till the pack expires. However, if they find any other pack to be beneficial, they can switch. in the hands of the customers. Put up for kind consideration and natural justice.

  3. It can be seen from counter comments given by me, no response from the service provider. Further, the latest guidelines of TRAI had given freedom to the customer to choose the plan according to their choice. No place, it is mentioned that service provider can breach the agreement suo moto without consent of of the consumer. Submitted for kind perusal and necessary action against the service provider.
