Honourable Court,
I would like to bring to your notice that I have recently upgraded to Tata Play Binge box after watching Tata Play Binge advertisement.
While ordering the Tata Play Binge, I was not informed of all the shortcomings of this box and the service.
Upon installation, I have discovered that I cannot record certain channels and I cannot pause live TV. I had enquired about recording feature while booking my order. Tata Play associate had informed me that once I subscribe to the recording plan, I will be able to record upto 100 hrs of programming. I paid the subscription amount. However, it was not disclosed to me that I cannot record certain channels such as Star Sports (454). I was also not told that I cannot pause live TV.
When the STB is ‘upgraded, consumer expects that the upgraded STB will be backward compatible and will support all the features of HD box plus offer newer features. It was not shared proactively by Tata Play associate that the upgraded Binge box is in fact inferior in certain features compared to HD.
I also do not remember signing any consent showing that this was informed to me or any other terms and conditions. And I do not have any email communication from Tata Play that this was informed to me.
I am very dissatisfied with the Tata Play Binge service. Hence, I kindly request the court to issue a notice to Tata Play to take the Binge box back and return my HD box and credit the amount paid. I am raising this complaint with the honourable court after trying my best to explain the issue to Tata Ply Customer Service. They have not been able to solve the problem let aLoan acknowledge it.
Further, please note tan Tata Play Consumer Service team has forcefully closed the case stating that once the STB is upgraded, it can not be downgraded and there will be no refund.
I will appreciate it you can acknowledge this complaint and reply to it as soon as possible.
I’m also following up by sending a legal notice for the same to Tata Play registered address with a copy to honorable court.
