Complaint regarding Misleading advertisement from No Broker
This is regarding my house which I put up for sale in Malad (W) with the process of OC underway. There was no dearth of buyers for my property, but getting my price was the real issue as the property did not have an OC.
Mr. Harshad from No Broker was desperately marketing their service who made many false disclaimers stating that they are specialized in selling properties with no OC with a good price as they have ready investors and builders who are willing to invest in the property and not concerned about OC. He insisted the payment to be made at 9:00 pm on March 16, 2022. The recording of which I have on my cell. He further, assured me he would allot me the best CRM AND MY FLAT WOULD BE SOLD IN ONE MONTHS TIME.
As it is a lock and key flat I had to personally go to show the flat. I requested for house visits on the weekends. Harshad made me buy the package on Friday night AT (;00 PM (NEFT payment details are with me) stating that he has got lots of builders and investors for the apartment. The weekend passed and nobody came for the flat. In the entire time of 3 months they managed to only bring 3 buyers who were interested only in the OC.
When this came to light Mr. Harshad conveniently vanished from the scene. He went on very long leave. Till date Harshad has never spoken to us he is either on leave, busy of has COVID. One Mr. Yash came on the scene and told me he is Harshad senior and hence forth he will handle the case and I should only talk to him. with same empty promises of selling my flat in one months time. He committed to saying that there are no builders and investors. It was only a marketing strategy.
I CALLED NO BROKER AND ASKED THEM TO REFUND MY MONEY AS I WAS NO LONGER INTERSTED IN THE DEAL AS THEY ADMITTED TO NOT HAVING ANY BUILDERS OR INVESTORS. CALL RECORDED ON MY CELL. This I did on the second day itself.
This was discovered on the second day of my taking the package I urged Yash to refund my money as I was not willing to go ahead with the deal, but they did not and went on lying that before the end of three months the stipulated time for the package to end they will sell my property
Then No Broker started playing the blame game marketing team pushed to onus on the operational team and operation team pushed the onus on the RM. This went on for three months. Till date when I call neither Mr. Yash nor Mr. Harshad comes on the phone incidentally, whenever I call they are on long leave for emergency.
The CRM designated to me was not at all effective. This was brought to their notice. His communication skills were very poor. After much persuasion the CRM was changed.
I even mentioned to them selling my property is not an issue as the building is only 5 years old and I have many brokers in the building itself, who I have to pay only after my property is sold. the only issue was getting a price for my property as they were asking for OC.
No such thing happened they could not even find any serious buyers for my property. In the three months time only 3 buyers came to visit the property.
After the time lapsed they have just closed the whole issue and are now saying that they have not given us any guarantee as to selling my flat. Now whenever we call we get a message the executive is currently busy and will call later. They never bother to return the call and are onlong leave.
Request you to kindly look into this matter and help me get back my refund for cheating gullible people.
I will wait for a revert for 7 days. Failing which I will have to take other course of action to settle this matter. This kind of dealing is fraudulent and a Complaint regarding Misleading advertisement from No Broker needs to be registered at the consumer forum where stringent action needs to be initiated. My money needs to be refunded to me immediately as I did not get the service promised and for which I have made a payment of Rs.10,000/- All proof will be furnished at that time.
