1. That the Complainant is a consumer within the meaning of Section 2(7) of the Consumer Protection Act, 2019, having purchased a product for personal use and not for any commercial purpose.
2. That the Opposite Party is engaged in the business of manufacturing/selling medicinal/healthcare products, including Perfectx Joint and Bone Treatment Cream, and is liable for deficiency in service and unfair trade practice.
3. That on 02.01.2026, the Complainant placed an order for Perfectx Joint and Bone Treatment Cream through the Opposite Party, on the assurance and offer of “Buy One Get One Free”. The Complainant paid the full consideration amount in shape of cash Rs. 549/-.
4. That the delivery was received on 06.01.2026. However, to the utter shock and disappointment of the Complainant:
o Only one bottle was delivered instead of two bottles as promised under the offer.
o The delivered bottle was in a very bad and unsafe condition.
o No label was affixed on the bottle showing ingredients, manufacturer details, batch number, or expiry date.
o The lid of the bottle was open, creating serious doubt about contamination, tampering, and safety of the product.
