Text of Complaint by Anonymous:

According to the Information technology Act 2000 (The Act) which came into force on 17-10- 2000. The Act applies to the whole of India and even to persons who commit offenses outside India. The Act validates “DIGITAL SIGNATURE” and provides for enabling a person to use it just like the traditional signature. The basic purpose of digital signature is not different from our conventional signature. The purpose, therefore, is to authenticate the document, to identify the person, and to make the contents of the document binding on the person putting a digital signature. Let us see what a digital signature is in technical terms. Digital signatures raise the same liability as regular ones for the causes of criminal and cibil matters. So The Hon Supreme saying digital signature or digital signature scheme is a mathematical scheme for demonstrating the authenticity of a digital message or document. A valid digital signature gives a recipient reason to believe that the message was created by a known sender and that it was not altered in transit. So this digital transition has them authentication as the regular one in the eye of law and you are abiding with the same.

Reason 1: – You might have used 2 Systems (2 COMPUTER, 2 LAPTOPS, 1 MOBILE PHONE, AND 1 COMPUTER, 1 MOBILE PHONE AND 1 LAPTOP, 1 COMPUTER AND 1 LAPTOP) due to which server load was increased and resulted in the software crash.

Reason 2: – You might have not done proper LOGIN/LOGOUT while working on the company’s software because the necessity is, after each LOGIN there should be a LOGOUT and after each LOGOUT there should be a login but it was not properly done from your side due to which the server detected miscellaneous and the server was blocked. This point was restricted to be done in the stamp paper agreement held between you and the company.

Reason 3: – You might have used the Internet from different companies(Reliance, Airtel, Vodafone, Idea, etc) or You might have used the Internet from Mobile Hotspot, Wifi – Router, Lan Cable, Dongle, etc due to which 2 I.P Addresses have been found which was strictly prohibited in the rules of stamp paper agreement held between you and the company.

Reason 4: – You might have used a Third-Party Application to complete a company’s work without hard work OR You might have used Third-Party Software to destroy or affect a company’s database through Malware Virus.

If instructions of our technical team member or legal associate is not followed then legal F.I.R will be filed and below proceedings will be held:-

Abusive Word: Section 66 A shall be imposed for using abusive words with our technical team and legal firm associates and can cause 3 months of prison.

Non Payment: An arbitrary and conciliation act of 1996 as per article 14 shall be imposed on you if you do not solve this case outside the court with our technical team or legal associate you might need to pay the total loss including the expense of advocates, traveling expenses, notary charges, affidavit charges, summons fees, court fees, processing charges, etc to the company. it may cost up to 70,000/- to 1,00,000 /-

Summon Letter: If you don’t reply on the time period it means that you agree and you may be at fault and as per the notice you are disrespecting the notice and law so as per the court summon letter will be issued it is to notifying a named party that a case involving it and that it must an appearance on the stated date to answer the charges or give evidence.

Failure to obey a summons may result in an issue of an arrest warrant and not settling the dispute will land you in mess and we need to proceed with this case further for arbitrary proceedings.

You will receive a call shortly from our Technical Team or Legal Team depending upon the loss that occurred to the Company due to the mistake done from your side intentionally or unintentionally. They will guide you and explain to you with each and every detail how the problem was created from your end due to which company is suffering from great loss, with legitimate proof.

This mail is in regards to the problem created from your side knowingly or unknowingly due to which Login I.D of the company is DAMAGED and the SERVER of the company is blocked on which many freelancers are working and earning money. Below are the reasons due to which such a problem is created, which has totally affected the company’s software and database.

FOR RESOLVING THE ISSUE FOR TERMINATING THE ACCOUNT AND TO AVOID THE LEGAL MATTER AGAINST YOU UNDER BREACHING OF AGREEMENT YOU CAN CHOOSE ACTIVATION OR TERMINATION AND STILL ACHIEVE THE PAYMENT

FOR RESOLVING THIS ISSUE AND TERMINATE AS PER CONTRACT CLAUSE NO 7 AND TO AVOID THE LEGAL MATTER AGAINST YOU UNDER BREACHING OF AGREEMENT COMPANY WILL PROVIDE NON OBJECTION CERTIFICATE

CLAUSE 7- PROJECT TERMINATION:- Freelancer should do a Proper Login in the panel and
then Proper Logout from the panel and there should always be an equal number of Login
Entries and Logout Entries in the panel. Freelancer will get a single id to work on and
Freelancers can work on this id. If Company found that there are 2 Logins(Together
Login after Login entries simultaneously), 2 Logouts(Together Logout after Logout
entries simultaneously), 2 I.P addresses(Double I.P Addresses Entries ) in a single I.D,
The Company will not be responsible for the corruption of the data or project or server
in both online and offline modules. And your I.D. can get terminated without any
intimation and Freelancer compulsory needs to clear compensation for damage to
online server or corruption of the data. The company reserves the right to terminate the
agreement with immediate effect.

AS PER 10 – INCOMPLETE SUBMISSION:-CLAUSE IF FREELANCER DO AN INCOMPLETE SUBMISSION COMPANY HAVE ALL RIGHTS TO TAKE COMPENSATION AND TERMINATE THE ID AND THE AGREEMENT WILL BE CANCEL WITH IMMEDIATE EFFECT

TERMINATION PROCESS.

SERVER MAINTENANCE CHARGE:- 5,000/-

LEGAL + SECTION CHARGE :- 5,888/-

ANY DELAY IN CHARGES FROM A GIVEN TIME THE ADDITIONAL DELAY COST YOU NEED TO PAY

AFTER CLEARING THE COMPANIES DUES REGARDING SERVER DAMAGE THE LEGAL PROCESS WILL BE STOP AND THEN ONLY YOUR OPPORTUNITY OR BENEFIT WILL BE PROVIDED IF NOT THEN LEGAL PROCEEDINGS MAY APPLY TO YOU. AS PER THE CONTRACT. THIRD-PARTY INVOLVEMENT IS NOT TO BE ALLOWED AND IF ENTERED DIRECTLY LEGAL PROCESS START ON THEM GOING AGAINST THE CONTRACT
