Dear team,
Myself,Deb kumar Mazumdar had applied for a housing loan in D.H.F.L. i.e. presently named as piramal capital and housing finance ltd in 2014.on 30th Aug 2014 ,via a sanction letter,I was informed that on 29th Aug 2014, Dhfl has approved my request for a housing loan and has sanctioned me a loan amount of Rs 7,64,117 .After receiving the said sanction letter ,I obtained the aforesaid money from the company vide loan acc no.00003786 and prior to receive the aforesaid amount as per direction of the company,I deposited all the documents of my property to dhfl as mortgage.being satisfied with the aforesaid documents,the company sanctioned the loan amt in my favor and the company also assured me that after receiving the entire loan amount with interest,the company with return the aforesaid mortaged property documents to me .
That thereafter on 14/06/2019,I sent a letter to the company (Dhfl) with prayer for one time settlement (ots) of the loan amount.I was agreed to pay rs 4,50,000 to the company as full and final settlement of my loan amount.on 31/07/2019,the company duly approved my proposal and sent a o.t.s. sanction letter with direction to pay rs 4,50,000 to the company as full and final settlement of one time settlement amount and also directed me to pay the aforesaid amt on and before 31/07/2019. In the said letter , the company specifically mentioned that the company will return the mortaged papers and documents of my property within 51 working days of post closer of the said loan account.
That thereafter as per direction and assurance given the company,I paid rs 4,50,000 as one time settlement amount to the company in total six installments within 31/07/2019 and the company also issued money receipts in favor of my payment.I was also assured that the company will close my loan and within 51days will return the mortaged papers and documents of my property.
That thereafter D.H.F.L., motivatedly and intentionally refused to return all the mortaged papers and
documents of my property.on 30/11/2020,they also send me a loan demand notice (one year prior to payment of settlement amount) in which they demanded overdue and additional interests amt of total rs 4,82,017 from me within the next 7 days from the receipt of the notice.but I refused to pay as I have already made the payment of one time settlement.Thereafter, I contacted the recovery manager many times and requested him to return the property papers but didn’t get any satisfactory answer or action from him.Then on 2022, after lapse of 2years of payment of ots ,I lodged a complaint to their consumercare and manager again and requested to handover the mortaged papers but thereafter there was no such response from the company.on 18/02/2022 ,I sent a advocate letter to the company and on 2023 they sent a reply letter in which they refuse to return the property documents due to breach in ots policy but no clear explanation is provided .I have all the original documents related to this case .
