Text of Complaint by H Castillo:

Firstly, I recently discovered that your company illegally accessed my contact information and used it to send messages and make calls to individuals who have no involvement with my loan whatsoever, including my current employer. This blatant disregard for privacy and unauthorized use of personal data is highly alarming and unacceptable. It not only violates my rights but also undermines the trust that customers place in your organization.

Secondly, I have been subjected to relentless harassment through incessant phone calls and text messages, not only directed at me but also targeting my contacts. This aggressive and intrusive behavior is causing significant distress and is in clear violation of ethical business practices. I expect a lending institution to operate with professionalism and respect for its customers’ boundaries.

Furthermore, I would like to highlight a concerning aspect of the loan agreement itself. The interest rate on the loan I initially applied for continues to increase on a daily basis. This blatant disregard for the regulations outlined in the SEC Memorandum Circular No. 3 series of 2022 is deeply concerning. As per the circular, the maximum nominal interest rate allowed is 6 percent per month, or approximately 0.2 percent per day, with an effective interest rate (EIR) of 15 percent per month, or around 0.5 percent per day for covered loans. The interest rate being charged on my loan far exceeds these limits, which raises serious legal and ethical questions.

Lastly, I was deeply disturbed to discover that your employees have been sending emails from different accounts, attaching files containing my personal selfie and identification documents. These files are meant to be private and safeguarded by your company’s confidentiality policies. It is utterly unacceptable for such sensitive information to be mishandled and shared inappropriately, potentially compromising my personal security and privacy.

Given the severity of these issues, I demand immediate action to address the situation. I expect a prompt investigation into these unethical practices, the cessation of all forms of harassment, and the removal of my personal information from your system and any associated databases. Additionally, I insist on an accurate recalculation of my loan interest in compliance with the prescribed legal limits.
