Text of Complaint by Subhen Ghosh:

1. No action is pending before any court against Overseas Bank of India (IOB).
2. Subhen Ghosh has accounts with the IOB for long time.
3. There are accounts in IOB in name of Subhen Ghosh’s deceased mother Amita Ghosh and Sumit Kumar Ghosh at IOB, Midnapore, WB 721101 Branch. See Gr Ex “1.”
4. Subhen Ghosh’s mother died in July 2012 and Subhen Ghosh is the beneficiary of her WILL. See Gr. Ex “1.”
5. As a result of her death, Subhen Ghosh became the co-owner of her all account at IOB instanter, and such rights are protected under law, and equity.
6. The IOB was requested to (a) add Subhen Ghosh’s name in all accounts of late mother Amita Ghosh, (b) to act on deceased claims of Subhen Ghosh as needed.
7. The IOB was requested to put all said accounts in inoperable status until (i) actions as requested in paragraph 5 are completed, and (ii) all probate matters are resolved.
8. The IOB failed to act on the requested matters.

WHEREFORE, Subhen Ghosh requests this Honorable Court to enter an order against Indian Overseas Bank, and in favor of petitioner Subhen Ghosh to put all bank accounts in operable status until (i) the name of Subhen Ghosh is added to the accounts of late mother Amita Ghosh as her beneficiary, (ii) all deceased claims are settled, (iii) all probate matters are terminated, AND for all other relief as proper in law and equity.
