Hi,

I availed a Car Loan facility from HDFC Bank (Loan Account Number 43291470) and was successfully paying all my EMI’s until Covid-19.
To lessen the burden of EMI’s I applied for restructure of loan which was approved by bank and I started clearing all my EMI (with some delay) however in the entire transaction of last 4+ Years I could not pay 5 Instalments (in total) owing to my poor financial condition for which HDFC collection team contacted me for repayment. They always asked to clear one EMI and clear the rest once I have funds available with me.
I was successfully paying all EMI and was also able to arrange funds to clear the 5 Pending instalments however last month Collection Manager from HDFC visited my house and checked my car and he offered me to sell the car and settle the loan. He even offered that I can sell the car to him and he will give me good deal on loan settlement. I however denied the proposal and informed him that I will clear 5 Pending EMI’s in next month.

HDFC’s collection manager didnt like this and he had a mallified intention to get my car because of its mint condition and started creating pressure on me to sell the car through several means.

Gradually, the harassment reached to a level where he came to my house and asked me to immediately clear all pending dues else recovery agency guys will take the car into their custody. I told him that I am not well and pleaded him to give me 10 days to clear the dues which he denied and threatened me that he will get this car by hook or by crook.

My wife requested him to give sometime to arrange for money however he behaved very rudely with her and told her that the only way to save from this harassment is to sell the car.

Immediately, after he left 5-6 people raided my house and asked me to handover car keys.. I told them that i am ready to pay the money and then why you are harassing me like that and they all mocked me in front of my wife and neighbours causing me social embarassment and said that they will definitely take the car and give it to the manager.

As I was not well and was unable to talk much, my wife tried to reason with them and pleaded for 2 hours but they kept insulting her infront of my neighbours also.

This was very tormenting and I called the manger several times but he did not answer my calls. I asked the recovery guys to show me their identity card which they denied and never produced any document that could prove that they were from HDFC bank.

I have read you grievance and redressal policy and nowhere its mentioned that HDFC bank can send goons to customer’s house and insult their family infornt of other people just because the customer missed few EMIs.. And In my case I was willing to clear the payment but they did not want the money and their only intention was to seize the car and hand it over to HDFC collection manager.

I was somehow able to save my car from these goons and knowing this the collection manager was very agitated and immediately started a legal action against me.
I received a legal notice from HDFC bank stating that I am willingly not paying instalments and should immediately clear entire outstanding amount to prevent further siezure of my car.

In that letter its mentioned that an arbitrator is appointed to hear this case on 3rd Sept 2022. I strongly oppose the appointment of that arbitrator as I never got any notice about appointment of the arbitrator and I strongly feel that he may give a one sided decision as he seems to be hand in glove with the manager.

Also, legally HDFC bank needs to give me notice in advance to oppose or accept the appointment of arbitrator which was not done in this case.

My only question to HDFC bank is that when I have been able to arrange funds and willing to clear 5 outstanding EMI then why all this is being done?

Is it that the entire system is supporting one or two corrupt managers who want to benefit from customer’s situation?

I am constantly being threatened that if I take my car out then it will be towed by recovery agents. I am under constant threats from car towing agencies, collection team, HDFC collections manager and lot of goons who keep visitng my place and keep threatening me.

I immediately seek help from HDFC bank to relieve me from this constant mental torture and let me pay my EMIs regularly.

I am also planning to change the ECS account so that EMIs can directly be debited from my account however it seems that even if I do so, I will still be in the threat of these goons and they will anyways act as per the direction of Colleciton manager.

I am on the verge of nervous breakdown, please save me.
