Text of Complaint by Sunil kumar:

I, Sunil Kumar, the complainant herein, state that I had availed a loan from the Opposite Party, Bright Loan / Bright Finance, and I have always shown bona fide intention to repay the loan. Due to a serious and unavoidable medical emergency in my family, I suffered temporary financial hardship, which was duly informed to the Opposite Party multiple times through emails and communications.

Despite being fully aware of my family medical condition and financial constraints, and despite the fact that I have already paid a substantial amount of ₹48,000 towards the loan, the Opposite Party continued to adopt aggressive, coercive, and unlawful recovery practices. The said payment clearly establishes that I am not a willful defaulter and that my intention has always been to repay the dues in a fair and lawful manner.

The Opposite Party has been continuously sending repeated emails from multiple and unauthorized email IDs, using threatening, intimidating, and pressurizing language. I have received constant threats of consequences such as blacklisting, field visits, and legal action, which has caused severe mental stress, anxiety, and harassment to me and my family.

Further, the Opposite Party has demanded excessive and unreasonable penalties, including daily penal charges such as 1% per day, which are arbitrary, unconscionable, and in clear violation of the RBI Fair Practices Code for NBFCs. Such penal charges are illegal and amount to unfair exploitation of a consumer who is already facing medical hardship.

Even after repeatedly requesting the Opposite Party to stop harassment and to communicate only through a proper legal and grievance channel, and even after issuing a cease and desist legal notice, the Opposite Party failed to correct its conduct and continued with unlawful recovery communications.

The acts of the Opposite Party constitute deficiency in service, unfair trade practice, and mental harassment, and are in complete violation of statutory guidelines issued by the Reserve Bank of India. The continuous harassment has caused immense mental agony, emotional distress, and loss of peace to the complainant.

Hence, the present complaint is being filed before this Hon’ble Commission seeking appropriate reliefs, including directions to stop harassment, declare illegal penalties as void, revise the loan account after adjusting the amount already paid, and award suitable compensation for mental agony and harassment caused by the Opposite Party.
