Dear Sir/Madam,
I got a mail on 12 may 2021 offering me a part time home based job of captache typing saying that if i complete 90% of correct captache within 8 days i will earn 22000/- and in good faith i also agree to join and started my work from 17th may, but no written agreement was signed.
From the first day they were technical issues and I called on helpline no. they were not receiving and then i mailed them, but issue was not resolved. I didn’t get any call or mail from technical team.
Then suddenly today i.e 24th May 2021 they text & mail me of advocate notice claiming to pay compensation. in the text message they are reffering to prelex technology and in the mail referrence of the company is ics technology.
They are threatening me through below messages
“Advocate will be appointed for the Arbitration proceedings at Indian Council of Arbitration court.Company will provide you last chance to clear the dues and settle the dispute outside the court.We will free you from all the charges & dues,Kindly call on 8140140833 } for avoiding legal proceedings.”
“On behalf of PRELAX TECHNOLOGY company as an Advocate associate,we have sent you intimation mail in your registered email id .Kindly check your mail box and reply or call on 8140140833 ATVTSF”
“We are trying to reach you and you are not answering the calls. To avoid legal action against you, call immediately at 8140140833 ATVTSF.”
“This is to inform you that your internal case id 04231756 has been listed on 24-05-2021 for Legal proceedings. Kindly call on 8140140833} for further details.”
“hard copy Notice of your ?Breach of Contract? case under the Section-73&74 has been dispatched at your address, which will be delivered to you within 72 working hours. Feel free to call at 8140140833 for any assistance as Government has appointed Public Prosecutor to work in your favor. ATVTSF”
“Under instructions from my client ICS CONSULT Company’s agreement term & Condition if you Not Complete the work or QC Fail in the work then you will be liable to pay the company penalty amount . If you are not paying a company penalty then the company is eligible to take legal action against you . Agreement breaching sections are imposed on you”
“The above sections are implemented on you regarding you did not full-fill the terms and condition of your agreement..
Section 73 :- Compensation for loss or damage caused by breach of contract. Compensation for failure to discharge obligation resembling
Section 74 :- Compensation for breach of contract where penalty stipulated for.
Section 75 :- Party rightfully rescinding contract, entitled to compensation.
You have 45 Minutes to pay the penalty otherwise the legal action will be initiated under fraud and agreement breach case. After this your penalty will be increased and only you will be responsible for it. If you ignore this letter, we will be filing a legal complaint against you without any intimation . Thank you for your cooperation.
Note :- There is time, however, to avoid a suit if you contact us within 30 minutes on this number 8140140833. This will be your final opportunity to resolve matters without the expense of court proceedings.
