I purchased Iphone 14 during BBD sale along with the option of exchange old phone.
I was promised phone was exchange within 7 days of delivery of iPhone and the date was provided to me was 23rd October.
However, I received a text message from Ekart on 19th October that pickup will be done that day, I waited all day long but no one arrived and at last i received the text “Pickup rescheduled for tomorrow”.
Again the next day same thing happened, I called your delivery executive and to my surprise he told me he won’t pickup as he has no knowledge of it. Then again dishonest and a fraudulent attempt by your logistics team stating that – Exchange was cancelled due to phone mismatched.
I have managed to produce the CCTV footage of my society where it is clearly evident he returned back from society main gate and never reached to my flat.
as per the Contract Act, Section 73-75 Suit for Damages, since the contract becomes VOID and done a fraudulent activity by deceiving a fake attempt to cancel my exchange,
I legitimately demand for full refund for my iPhone along with the compensation of Rs 25,000 for the loss of my productive time and mental peace and also based on following –
1. Fradulent rejecting the exchange by your Ekart partner.
2. Non commitment of the promise of contract.
3. Blocking my capital funds since you aren’t able to complete the full contract at first place.
