Text of Complaint by Naveen Kumar Kalyankar:

I have already sent the 2nd ​Notice to Amazon India for ​non response for the earlier notice sent on 1st July 2021 and for the ​default and Non-delivery of the Amazon Order No. Order Id: 404-8507616-1067502 (Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) and Amazon Order No. 404-3526548-6073945 ( WOTRA King S310 Stainless Steel Easy Clean Spin Bucket Mop with 2 Rifill)  and subsequent refund of amount of Rs. Rs.2,299/- and Rs.670/-  totalling of Rs. 2,969/- to my original payment source along with the damages with immediate effect for breach and default of said delivery of the product and without causing further trauma and mental harassment.

Please find the complaint and detailed summary of the serious fraud committed by Amazon Retail India Pvt. Ltd and Amazon Seller Services Pvt. Ltd.,

Default and non-delivery of product issue -1 – (Amazon Order No. Order Id: 404-8507616-1067502 – Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black)

– On 23rd June 2021, I have ordered Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(BlacK) – Qty 2 no’s with the price of Rs.2299/- for each BP monitoring device total for 2 Qty – Rs.4598/-

-On 26th June 2021, To my shock the Amazon delivery executive said he has to deliver four packets and asked for the OTP for the below products

  1. Smart Shelter Premium Heavy Duty/Top load washing machine……..Qty-1 No’s packet (order Id.404-3632000-0393156)

 2.Pedigree Adult Dry Dog food, chicken & Vegetables , 3kg pack – Qty-1 no’s packet

  1. Exchange product for Doodle Uber cool Fun colourful hip flip flops for kids -Qty-1 No’s packet ( Order id: 408-5506651-2739566)
  2. Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) – Qty-1 No’s packet and ( Order Id: 404-8507616-1067502).

To My shock when I started verifying the delivered products and the following are the issue and discrepancy of the delivered order on 26th July 2021 by Amazon.

  1. I have noticed that Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) – ( Order Id: 404-8507616-1067502) and only Qty- 1 No;s delivered against order of the Qty-2 No’s.
  2. Even the delivered Qty-1 no’s product against order for Qty02 No’s of the product of Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) – ( Order Id: 404-8507616-1067502 has the wrong product and it is completely different from what I have ordered. The product delivered was a low cost model of Dr. Trust Comfort Pro115 blood pressure monitor instead of the actual product ordered Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black). Amazon has billed and received money of Rs.4,598/- whereas Amazon delivered only 1 No’s of the said above product.

I am hereby attaching the picture of all the 4 different orders and products delivered by Amazon on 26th July 2021 for your reference and as proof ( Please find the picture proof of the Product delivered to this mail.) This picture shows clearly that the 5th Product is not delivered by Amazon but the Amazon tracking status in the Apps and order history shows the status of tracking the product that is delivered which is completely fraudulent and unethical.

It is clearly shown that the 2nd Qty of  Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) – ( Order Id: 404-8507616-1067502) is missing from the delivery but the amazon App shows it is delivered..

Also the Product delivered for the Qty -1 No’s is a cheaper and wrong product delivered because the delivered product was Dr. Trust Comfort Pro115 blood pressure monitor instead of the actual product ordered was Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black). ( Please find the picture proof of the only 1Qty and that wrong and cheaper Product delivered against the original order of Qty 2 no’s to this notice.) and the 2nd Quantity of the product was non delivered.

This shows clearly that Amazon has messed up the order by not delivering the 2nd Qty of the product of Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black)and also the delivered the wrong product for the 1st delivered product.

I am really very disappointed by the treatment of your Amazon customer care team which lacks professionalism and understanding of the issues and this has happened several times and it happened that the Amazon customer team especially the Amazon customer care leadership teams slammed the phone while the conversation was going on.

I also like to bring to your notice that the Delivery agents are sometimes very very rude and arrogant, attempt to assault and misbehaves with customers when questioned of their wrong doing and they do not wait for the customer verification of the products delivered and mark as delivered where actual delivery has not happened.

With all of the above issues once again, I have lost trust with Amazon and don’t feel comfortable ordering on Amazon and I feel threatened from your delivery executive to the customer care executives including customer care leadership team.

  Default and non-delivery of product issue -2  – (Amazon Order No. 404-3526548-6073945 – WOTRA King S310 Stainless Steel Easy Clean Spin Bucket Mop with 2 Rifill)

Again On 1st July 2021, exactly after 5 days of the 1st delivery fraud by Amazon on 26th July 2021 reported by customer to Amazon and the same delivery fraud on 01st July 2021but different Modus operandi was used here by Amazon delivery agent for the Amazon Order No. 404-3526548-6073945 ( WOTRA King S310 Stainless Steel Easy Clean Spin Bucket Mop with 2 Rifill) on 1st July 2021 and this issue is reported and escalated to Amazon.

This time with due caution and from lessons learnt from previous Amazon delivery fraud noticed and reported on 26th July 2021 . I caught the Amazon delivery agent red-handed while leaving the apartment and taking back the product without actually delivering the product but showing it as delivered in the Amazon App for product tracking. I have to take the picture as proof and the picture clearly shows the Amazon delivery holding the products in his hands that were supposed to be delivered. The following of sequence of events as below

1)    The Amazon delivery agent comes for the delivery of the product

2) The Delivery agent Scan the products for delivery

3) Instead of leaving behind the package/product the Amazon delivery agent takes back the products along with him and not delivering the products ( as shown in the picture attached as proof)

4) The Amazon App tracking show the products are delivered for the Order No. 404-3526548-6073945 ( WOTRA King S310 Stainless Steel Easy Clean Spin Bucket Mop with 2 Rifill) on 1st July 2021 whereas the delivery was not done and Amazon agent has stolen the product by faking as delivered ( Picture attached to the Notice as a proof whereas where Amazon delivery agent is holding the product in his hand).

5) On questioning the breach and fraud committed by the Amazon delivery agent/ employee then he turned abusive and try to assault and most dangerous part is that he was in volitation of COVID19 protocols by not wearing the masks and maintain social distance by breaching the law as per Government of India and Government of Karnataka COVID19 guidelines and protocols under The Karnataka Epidemic Diseases Act, 1897 and it is clear volitation and breach the Covid 19 protocols and endangering my life as well as family’s safety ( the Proof of picture of COVID19 protocol volitation By Amazon delivery agent attached to the Notice)

The most disgusting part is that , when I questioned the delivery agent of wrongdoing and he started abusing me and tried to threaten and assault me and I was taken aback because the Amazon delivery agent was not following the COVID19 guidelines and protocols/ behaviour by not wearing the mask, not maintain social distancing as per Government of Karnataka Covid 19 guidelines under The Karnataka Epidemic Diseases Act, 1897 and this is clear violation of the law and endangering customer lives by this dangerous and reckless behaviour. His aggressive behaviour was so violent and scary and that too he was not wearing the mask and maintaining the hygiene and covid protocol. Luckily, I have taken the picture of the Amazon rogue delivery agent who tried to cheat first and when caught, he started misbehaving, abusive, and attempted assault and the most dangerous part is that he violated the Covid 19 protocol laid by the Government of India and Karnataka.

I have attached the picture and video proof of the Amazon delivery agent fraud and violation of Covid19 protocol  and it clearly shows in the picture and video proof his aggressive behaviour and violation of COVID19 guidelines and protocol in the short video and picture proof attached as Annexure to the complaint

When this delivery fraud was brought to the notice of Amazon Sr. Executive Management including Mr. Amit Agarwal, Managing Director of Amazon India, he choose to ignore my 15 + e-mails, more than 500+ tweets and Facebook posts, more than 8-10 hours of phone conversation with Amazon customer services team including their leadership team. As of 01sy July 8:30 PM IST, I do not have any response or commitment, communication on resolution from Amazon. One of the worst experiences is with the Amazon customer care team, I must say, it is one of the worst, arrogant, irresponsible, fraudulent, misleading and always giving misinformation to the customers. The Amazon customer care team’s attitude is always deceit and lies. They never give correct information or update or keep their commitments of call back or mail responses on the status of resolutions and the horrible part is that they even slam the phone while the customer is talking when they do not have an answer. This shows that Amazon Management has trained their staff to commit the frauds and be elusive when customers contact Amazon customer care.

​As Amazon has failed to respond to earlier notice sent dated1st July 2021 and this is the 2nd Notice to Amazon and failure of resolving my issues therefore I am filling a consumer complaint against Amazon Retail India Pvt. Ltd and Amazon Seller Services Pvt. Ltd for ​non response, breach of trust and non performaing the contract commitment, wilful intention to commit the multiple delivery fraud for a prepaid orders and endangering and threatening myself and my family member’s life by volitation of COVID19 guidelines and protocol laid by Government of Karnataka under The Karnataka Epidemic Diseases Act, 1897 and also causing with Emotional distress, trauma and mental stress by issue treats, abusive and assault attempt by Amazon delivery agent.

This mail communication is being issued without prejudice to all my rights, remedies and privileges whatsoever in law(s) to seek damages for the endangering the lives of citizen of the India by violation of COVID19 guidelines issues by Government of Karnataka under The Karnataka Epidemic Diseases Act, 1897 by not wearing mask at the time of delivery fraud attempt,  breach of trust and gross criminal negligence and causing the wilful and deliberate loss of time, mental trauma, mental agony, threatening of Life & personal peace of myself and my family members, breach of customer trust, misrepresentation of information and endangered to personal and public health from Amazon delivery agent and Amazon customer care team repeatedly time and again without having any responsibility towards customer.

My sincere and humble request to you for the justice and help me to get the refund from Amazon for the non delivery of the product and also for the damages caused due to negligence of the Amazon employee and wilful cause of mental trauma and harassment and followed by punitive action against Amazon Retail India Pvt. Ltd and Amazon Seller Services Pvt. Ltd for the wilful multiple delivery frauds.

The picture and video proof Amazon delivery agent was not following the COVID19 guidelines and protocols/ behaviour by not wearing the mask, not maintaining social distancing as per Government of Karnataka Covid 19 guidelines under The Karnataka Epidemic Diseases Act, 1897 and this is clear violation of the law and endangering customer lives by his dangerous and reckless behaviour when questioned, he tries to assault and abuse me.

The Amazon Invoice for the Amazon Order No. Order Id: 404-8507616-1067502 (Dr. Trust Atrial Fibrillation Automatic Dual taking Digital BP Monitor Machine(Black) and amount of Rs.2,299/- and and Amazon Order No. 404-3526548-6073945 (WOTRA King S310 Stainless Steel Easy Clean Spin Bucket Mop with 2 Rifill)  and amount of Rs.670/- for the Products which are not delivered.
