I got a massage on saturday that do you have intrested part time job I said yes after the massage kela he sent a text and said you have to type 200 pages within 5 days and the registration fee is Rs 7200. It will be taken from your salary. Pagar 20000 was offered, then I also thought that I should do it. I asked them to send me the voter id photo and I immediately put it. After the registration was done, I was asked to sign an agreement, that is, I asked for the photo and signature. I sent it and completed the registration. Done and I was given ID and password by mail from BRIGHT SPARK company, and said you have 5 days to type 200 pages before that. I typed those pages 2 days ago. Then after 2 days I got a mail from an Advocate Sidharth Roy and he is saying that This Intimation Letter _Company has filed a Inform you, That BRIGHT SPARKS case under the SECTION of 73-74-75 of INDIAN CONTRACT ACT 1872 for contract breach against you. as under law that mention on THE AGREEMENT that if you have not succeeded on your job then you have to pay the penalty amount.
Remedies for breach of contract.
Sec 73 Compensation for loss or damage caused by breach of contract proximate losses not remote/indirect losses.
Sec 74 Compensation for breach of contract Where penalty specified. Sec 75 party who is rightfully rescinding is entitled for compensation.
IPC SECTION
SECTION-406 Punishment for criminal breach of trust Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
The above sections are implemented on you regarding you did not full-fill the terms and condition of your agreement…
If you want to avoid the legal proceedings pay the company maintenance charges 7,200 within 30 minutes court server time.
Note: If you are not closing this matter out of court settlement then after clearing this matter you have to attend the court physically with your advocate. If they are talking like this, what can I do now? please help
