Text of Complaint by ANWAR ALI:

Respected Sir/Madam,

I, Anwar Ali, had been working under a contractual arrangement with Easy Pay Ltd. since 2020. On 24th November 2022, I had withdrawn an amount of ₹15,634 through AEPS (Aadhaar Enabled Payment System) services. However, this amount has not been settled into my linked bank account till date.

After several follow-ups, the company representatives repeatedly assured me that the amount would be credited within 48 hours, but despite waiting for more than a year, no settlement was made.

On 6th August 2023, Mr. Vikas Makwana, Manager of Easy Pay Ltd., executed a written contract with me and again requested confirmation of my bank account details. I duly provided the confirmation as per their instructions. However, despite these steps, my pending amount of ₹15,634 was never released.

I made continuous attempts to contact the company via emails, phone calls, and reminders, but they failed to provide any satisfactory response or resolution. This clearly amounts to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019.

Legal Provisions Attracted:

Section 2(11) & 2(47), Consumer Protection Act, 2019 – Deficiency in service & Unfair trade practice.

Section 35, Consumer Protection Act, 2019 – Right to file complaint for redressal.

Indian Penal Code (IPC) provisions may also apply:

Section 403 IPC – Dishonest misappropriation of property.

Section 406 IPC – Criminal breach of trust.

Section 417 IPC – Cheating.

Section 420 IPC – Cheating and dishonestly inducing delivery of property.

Relief Sought:

Immediate release of my pending settlement amount of ₹15,634 to my bank account.

Interest @18% per annum for the delay caused for over one year.

Compensation for harassment, financial stress, and inconvenience caused.

Cost of legal proceedings to be borne by the respondent.

In view of the above facts and provisions, I humbly request the Hon’ble Commission to take strict action against Easy Pay Ltd. and direct them to release my pending dues along with suitable compensation.
