COMPLAINT
1. Facts of the Case
That the Complainant had availed a loan through Loanpay.com, which is a partner of Goodskill Securities And Services Ltd.
That during the course of repayment, the Opposite Parties appointed a recovery agent named Mr. Gautam Singh (ID: GSL0031).
That the said recovery agent has been continuously harassing, threatening, and mentally torturing the Complainant through repeated phone calls from mobile number 8826660028.
That the recovery agent used abusive, intimidating, and coercive language, creating extreme mental pressure.
That due to this constant harassment, the Complainant has suffered severe mental agony, emotional distress, and humiliation, to the extent that the Complainant was made to feel hopeless and driven towards suicidal thoughts.
That such conduct is illegal, unethical, and in direct violation of RBI recovery guidelines, principles of natural justice, and the Consumer Protection Act, 2019.
That the Opposite Parties are vicariously liable for the acts of their recovery agent, as he was acting on their behalf.
That despite the harassment, the Complainant was willing to resolve the matter amicably, but the Opposite Parties continued their unlawful recovery practices.
2. Deficiency in Service & Unfair Trade Practice
The actions of the Opposite Parties amount to:
Deficiency in service under Section 2(11) of the Consumer Protection Act, 2019
Unfair trade practice under Section 2(47)
Criminal intimidation and mental harassment
Violation of RBI Fair Practice Code for recovery agents
3. Mental Agony and Harassment
The Complainant has suffered:
Severe mental stress and anxiety
Emotional trauma and humiliation
Fear and loss of peace of mind
Health issues due to constant threats and pressure
The behavior of the recovery agent is inhuman and unlawful, causing irreparable harm to the Complainant’s mental well-being.
4. Reliefs Sought
In view of the above facts, the Complainant respectfully prays that this Hon’ble Commission may be pleased to:
a) Direct the Opposite Parties to immediately stop all harassment and coercive recovery practices
b) Direct the Opposite Parties to pay compensation of ₹__________ for mental agony, harassment, and emotional distress
c) Impose penalty and costs on the Opposite Parties for unfair trade practices
d) Direct the Opposite Parties to issue a written apology to the Complainant
e) Pass any other order(s) as this Hon’ble Commission may deem fit in the interest of justice
