Text of Complaint by Soudamini Sharma:

It is most respectfully submitted as under:-
1. That the complainant placed an order on amazon for amazon prime membership for Rs. 1499/- on the 20th of July, 2022 and due to connectivity issue could not make the payment at first.
2. That, on second attempt to make payment for the said order, the money was debited and there was confirmation of payment.
3. That the payment was made using third party app i.e. Google Pay. The first try of payment was made at 10:27 PM which was denied due to connectivity issue and the second attempt was made at 10:40 PM which was successful and got through.
4. That the order placed did not confirm and the on reaching out to the customer care it was confirmed that amazon did not receive the payment.
5. The complainant inquired with the respective bank i.e. Jammu and Kashmir Bank, branch: Patel Nagar, Kathua-184101 and received confirmation that the money were debited.
6. That on inquiring with the third party payment app Google Pay, it was affirmed that the payment was successful meaning thereby that amazon received the payment.
7. That the complainant is a student and had to visit the bank for this matter multiple times leading to mental agony and has made multiple calls to the bank and third party app’s customer care service.
8. Further, the complainant has made inquiry with customer care of the amazon multiple times and has got the same response that the payment on the said date was not received and complainant was suggested to file charge dispute in the bank.
9. That the bank has reverted with regards to the charge dispute and it confirms that the beneficiary i.e. amazonpay has received the payment on the same day it was made i.e. 20th July 2022.

PRAYER
It is therefore, prayed as under:
i. That the opposite party may be directed to look into the payment and provide refund for the same
ii. The opposite party may also be directed to pay exemplary damages amounting to Rs 10,000 towards mental agony and sufferings to the complainant.
iii. Any other reliefs which the court may deem fir and proper under the circumstances of the case may be passed in favour of the Complainant.
