Text of Complaint by Swanand Palnitkar:

I, Swanand Palnitkar, have been a subscriber of DrinkPrime for over two years. The company charges monthly subscription fees for water services. As per standard subscription practice, a consumer is entitled to a full billing cycle from the date of payment. However, DrinkPrime has been following a hidden and unfair practice of reducing the validity of my subscription whenever there is a delay in payment.

For example, if payment is made 5 days after the due date, my subscription validity is also reduced by 5 days, while I am still charged the full monthly fee. This amounts to unjust enrichment by the company and denial of service to me as a consumer.

I have carefully reviewed DrinkPrime’s Terms of Service. Nowhere is this “fixed cycle” deduction policy mentioned. By not disclosing this condition, the company has engaged in concealment of facts, deficiency of service, and unfair trade practice as defined under the Consumer Protection Act, 2019.

Over the past two years, I have lost significant service days while being charged full amounts. This has caused me recurring financial loss, harassment, and mental agony. The practice is exploitative and has continued despite repeated losses suffered by me as a consumer.

Relief Sought:
1. Direct DrinkPrime to stop this unfair deduction policy and calculate subscription validity from the actual date of payment.
2. Refund the monetary value of the lost service days for the last two years.
3. Award me compensation of ₹10,00,000 (Ten Lakhs) for financial loss, harassment, and mental agony caused due to this malpractice.
4. Impose litigation costs on the Opposite Party.
