COMPLAINT LETTER
Dear Sir,
1. I, Nikhil Sharma R/O Harthala Sabji Mandi Kanth Road Moradabad, Uttar Pradesh, 244001 Mobile No. 9557441170 hereby request you to undertake immediate, positive and necessary action on my matter being the Managing and Controlling authority/Authorised Signatory of the FLIPKART INDIA PRIVATE LIMITED.
2. On 15th October 2020,I had purchased Mobile Phone Samsung Galaxy Note 10 Plus (Aura Glow, 256 GB) from your Flipkart Application, vide Order ID OD219959873066804000 under Flipkart Smart Upgrade Plan by paying monthly installment of Rs.4,417/- and total amount to be paid Rs. 36,838/-.(Email Attached to the mail).
3. I was paying the monthly installments on time and have already paid Rs.20,338/- for the product and willing to pay the remaining installment of Rs. 16,500/- with or without availing installment plan.(Invoice Attached to the mail)
4. I received a mail on Sat, Sep 18, 2021 at 9:45 PM from the seller intimating about the Flipkart Smart Upgrade Window Plan by providing two options:
“-Upgrade your mobile
On successful upgrade, you need not repay the Rs. 16500 advance availed. Buy a new mobile and give back your used Galaxy Note 10 Plus with that order. Choose from our products to stay up to date with the latest technology!
-Keep your mobile
Repay Rs.16500 advance availed before 18-Oct-2021 and continue using your Galaxy Note 10 Plus. This amount will only be due if you do not upgrade within the mentioned window.
In case you do not upgrade or make the payment by 18-Oct-2021, your Galaxy Note 10 Plus will be locked as per the agreed terms and conditions.” (Email is attached to the mail)
5. On receipt of this mail I decided and choose to keep the mobile and pay Rs.16,500 and clear all the dues before 18-Oct-2021 and continue to use Galaxy Note 10 Plus. I was trying to make the payment by clicking on the payment tab button mentioned in the mail. While doing so I found that Iwas unable to login my Flipkart Account and thereby failed to clear the payment.
6. When facing such a technical issue I approached your executive via telephonic connection on a toll free number and requested their assistance in this regard but I did not receive any proper response or way out to clear the payment and continue using the cellphone. Being a consumer I had no choice other than repeating requests and calls to your department and seeking assistance which all went into vain.
7. Considering your statement received via mail which states that “In case you do not upgrade or make the payment by 18-Oct-2021, your Galaxy Note 10 Plus will be locked as per the agreed terms and conditions.” has put me in a state of despair and cause unnecessary trouble when I am willing to pay and clear the dues.
8. I have raised complaints via calls and emails regarding the grievance but all efforts went useless and further all above acts on your part has caused me great loss and damage besides mental tension, trauma and inconvenience and loss of value of money.
9. That, such facts and circumstances, as stated herein above in the present complaint letter, I hereby call upon you the addressee, and enable me to pay the balance amount and do not create unnecessary trouble, threat or any hindrance and pressure on my mind by making such statements of locking the mobile phone if balance is not paid when i am ready to pay the balance amount. What kind of justice is this to a consumer who is ready to pay and continue using the product and you are creating unnecessary trouble. I have purchased this product with my hard earned money and your such actions will lead me to a state of suffering of mental, physical and economical agony.
10. You are not allowing for the clearance of the dues which a consumer is ready to pay thereby you are not allowed to lock the mobile phone on any terms and conditions.
11. In the future, if you take an action and lock the mobile phone, the onus or the liability of that shall lie upon you (the seller) and which shall force me to take shelter of the court of law at your cost, damages, compensation, and consequences, accordingly.
