Bought a new product from online seller Flipkart and delivered a used/defective product. Now, They are not helping me for replacement as per the policy

Text of Complaint by Rajnish Ranjan:

Dear Sir/Mam,

I have bought a real me 8 pro phone and it was delivered on 4th June’21. While unboxing the phone, the seal found broken and the number of fingerprints on display from the top of it phone was in “Switch on” condition. Also, the display has no plastic skin which clearly says the phone is used.

Hence, a complaint was lodged and the phone was kept the same as received. A technician visit scheduled very next day who didn’t come so I brought my phone to him for inspection cuz I was heading on the same way.

Again, on top of it, a new person inspected the phone and share some images to the “appointed technician” who had no clue/no interest in the inspection. The new person who sent me back to flipkart will share final feedback.

Finally, received my feedback the return is rejected cuz only can be accepted if there are some damages/issues. I told them the same above so I decided to check the product thoroughly and raise the return again.

Some issues were found like the display is very dim(not like Amoled or some HD), secondly, camera is the worst part. Hence, again called up the customer care and informed me the issue is resolved and if any other issue check with the nearest service center.

I just have some questions from Flipkart.

1) Have I not paid the full amount? Why should I keep a used phone if the complaint was lodged within an hour of delivery? Also, I have the unboxing videos to make my statement true.

2) Screen scratches/performing not well didn’t fall under your policy?
