I got a WhatsApp message from a lady named Priya and “WHITE CORD”, they asked if i was interested in part time data entry job and asked me to make an agreement, and I was only given ten minutes to upload my documents and to get the agreement (but I did upload my details ). After 6 days their advocate contacted me and said the company has filed a case against me and If you wont pay the compensation amount of 6,700/- as a penalty for not compliting the work. I paid the amount and later they asked me to pay 21000 as a out of court settlement or else I must pay More Amount and Lawyer will approach for legally. If i pay that they told me, they will send NOC on the agreement cancellation. So I paid that as well. Later they are asking again 34000 and then i relaised its Scam. I havent paid the Amount then, he send me a Section details email.
This Intimation Letter Inform you, That WHITE CORD Company has filed a case under the SECTION of 73-74-75 of INDIAN CONTRACT ACT 1872 for contract breach against you as under law that mention on THE AGREEMENT that if you have not SUCCEEDED ON YOUR JOB THEN YOU HAVE TO PAY THE PENALTY AMOUNT.
Remedies for breach of contract.
Sec 73 – compensation for loss or damage caused by breach of contract proximate losses not remote/indirect losses.
Sec 74 – compensation for breach of contract Where penalty specified.Sec 75 – party who is rightfully rescinding is entitled for compensation.
IPC SECTION
SECTION-406 – Punishment for criminal breach of trust – Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
The above sections are implemented on you regarding you did not full-fill the terms and condition of your agreement..
If you want Avoid the Legal proceedings pay the company maintenance charges 6700 within 30 minutes court server time.
Note :- If you are not closing this matter out of court settlement then after clearing this matter you have to attend in the court physically with your advocate.
