I am subjected to humiliation, agony and mental tension since 08/02/2021 by Sh.K.K.Batra, Chief Manager, PNB, Navyug Market, Ghaziabad and other Distinguished Desks of PNB viz., Care, The Principal Nodal Officer, FRMD, ZO-Delhi and Hon’ble MD despite 6-7 Emails and Speed Posts of Hard Copies of Emails since 08/02/21 till 12/03/2021 for not re – crediting my financial losses of Rs.71000/- by Fraudulent cash withdrawal from my S.B. A/c on a CROSSED cheque No.032482 of my S.B. A/c of the branch, Navyug Market, Ghaziabad, which issued for Rs.249/- in favor of Bank of Baroda and given to Sh. Divyansh Bhargav ( Aadhaar ID -7895 8139 0938 and Mobil No.70810 60781 ). It being a CROSSED CHEQUE, Signtures on overleaf was also made which was required to fill up the details of the documents to process my loan. The culprit has ERASED all viz., Crossing of cheque ” A/c Payee Only”, beneficiary name, amount in words and figures and ENTERED his name, amount in words and figures as Rs.71000/- but with a Different Pen and Ink as against the Signatures on the Cheque. 2. The PNB, Navyug Market, branch made the payment on the cheque to the bearer IGNORING THE IRREGULARITIES on the presented cheque. These are– (1). Erasing spots of Crossing of the Cheque with words as” A/c Payee Only”(2). Erasing spots in the name of Beneficiary as are visible in the GAPS OF WORDS VIHAN SHARMA. (3). Erasing spots for the amount in figures ” 249/-” (4). Erasings pots of Symbol ” / ” (Oblique or slash), which is EXISTING in between the amount in figures 71000 (5). Erasing spots in between the Gaps of amount in Words “Seventy One Thousand Only “. (6). The payment at the Cash Counter was made without verifying the recorded Mobile No. of the Culprit. (7). The ID of the bearer is also not taken by the PNB AT EVEN THREE DESKS though it is Mendatory as per Hon’ble RBI Rules especially from a Non – Based Branch Customer when amount of Cheque is Rs. 50000/- or more. Here in this case the cheque presented was of Rs. 71000/-. (8).Different pen and ink are used to fill up the name of beneficiary, amount in words & figures and date AS COMPARED TO THE INK AND PEN FOR THE “SIGNATURES” which is in CONTRAVENTION of RBI Guidelines. 3. The above* Irregularities were made at THREE DESKS AND ALSO BASIC GUIDELINES OF RBI ARE NOT STRICTLY FOLLOWED. (A) At the very First Counter when token was delivered to the culprit, (B) At the Second Counter, when the cheque was passed ignoring the Erasing Spots and without the actual process of asking of ID and Address of the Bearer; asking confirmation from me about issuance of Bearer Cheque; & identity of the Bearer from me at my Mobile No.; not serving of any SMS on presentation of the cheque at the desk and not after payment of Rs.71000/-. (C) At the Third (Cash) Counter even when payment was made without verifying the Mobile Number as written by the Culprit. 4. The Bank has allowed the Cash Withdrawal to the presenter after taking his ID, which is witnessed by the Bank executive who did record his name as Sh.Vihaan Sharma but Bank has not nabbed the culprit on the basis of that ID. 5.The branch, though agreed their lapse on 12/03/21but has not made CCTV Footage Check to nab and nail out the culprit. 6.The branch agreed that lapse has occurred in noticing the erasing of CROSSING Words.I requested branch on 12/03/21 to Re-Credit the amount at once, through Speed Post. But PNB opt to keep mum.
The matter was taken to RBI Ombudsman on 16/03/21, but after 5 months period they rejected my complaint under Clause (13)(a), which reads that the complaint is not covered under Clause (8) of RBI Ombudsman Scheme 2006.No email in this regard is shared at my email ID pkgupta152@gmail.com.
The issue taken up with all concerned CEPC desks including the chief principal CEPC at delhi / Mumbai On 23/07/21 and subsequent reminder on 10/08/21. And now complaint against RBI in contact section on RBI Website on 19/08/21and again on 31/08/2021. But I am unfortunate to get a reply and all distinguished desks opt to keep mum, for the reasons unknown to me. I am under severe mental tension for this financial loss of Rs.71000/-. I request your honour to get me redress my loss through PNB.
