I, Shanti Mahadevan, am a Senior Citizen lady running 70. Because of age, Corona and being aloan, I am afraid to get out of my house to file FIR. My immunity is low and I dont want to get Corona. PLEASE treat this Online Complaint as urgent and kindly help me.
I wanted to sell my small, old flat in Gorai 2, Borivali [west] through an agent whose name is Yogesh Godambe (Mobile – 74981 25231). He was working as a partner along with one Tushar Shelar (Mobile – 88281 50481 & 81691 53246) at Shree Sai Associates, Shop no 3, Lodha Society, Karter Road No 9, Opp Dubey House, Borivali [east], Mumbai – 400066.
In mid – November 2020, Yogesh Godambe came with Tushar Shelar and collected copies of my flat documents along with Aadhar, PAN, photographs. The flat to be sold is at 304, Gorai indira chs, Plot 77, Gorai – 2, Borivali [west], Mumbai – 400092.
Yogesh Godambe insisted on advance payment of Rs1,50,000/- by cash towards his services and expenses. When I refused for advance payment and cash payment, he reasoned with me saying that after spending his time, energy and money on finding a customer for a flat, the seller backs out. With my advance payment, Yogesh said he would feel ensured I would not back out and so collected the payment in advance.
Yogesh collected 3 postdated cheques because I did not have ready money in my account. I had to take from someone and he promised the sale of the flat before 31 December 2020. Later he delayed the sale to 15 Jan 2021, 31 Jan 2021, 15 Feb 2021, 28 Feb 2021. The details of the cheque payments are as follows –
a] cheque no 408937 of 22/11/2020 for Rs70,000/- favouring Yogesh Godambe
b] cheque no 408938 of 12/12/2020 for Rs25,000/- favouring Yogesh Godambe
c] cheque no 408939 of 05/01/2021 for Rs55,000/- favouring Yogesh Godambe
Yogesh deposited the 3 cheques in his Savings Account No – Sb/GEN/81 at Shamrao Vithal Co-op Bank. I understand that his place of residence is between Mira Bhayandar – Vasai but his address can be got only from his bank. I do not have his bank branch details to track his address. He told me he had found a party for my flat but till date he has not shown me any paper work nor the buyer.
From first week of February 2021, he has been somewhat avoiding my calls and messages. And from first week of March, he has blocked me completely on Whatsapp and normal calls. As he had not kept his promise of selling my flat within the promised time frame, I have been sending out SMS to Yogesh, asking him to return all my documents and my entire money but he does not respond.
As all communication with him is blocked, I have been also sending him messages though his 3 contacts who are sometimes in touch with him –Shelar (8828150481 & 8169153246) also into estate business,
Ashfak (9833277969) also into estate business, and,
Mujahid Bhai Ali (9892332277) whose nature of business I am not aware of.
Yesterday, on 9/4/2021, I learnt from Tushar Shelar that Yogesh Godambe has cheated two other people and has not done their work too. Also that he has recently bought a car and is not in association with Shree Sai Associates any more.
Yogesh has caused me terrible stress and anxiety along with expenses at my age from mid November 2020 till date. I request you to please help me out of this situation. Attached are details of payment made by me by 3 cheques. My advocate asked for his residence address which can only be got from his bank or from his mobile details.
I request you to PLEASE help this senior citizen woman of 70 to get get my money back.
